The provisions of this article shall apply except when it is
necessary to stop a vehicle to avoid conflict with other traffic or
in compliance with the directions of a police officer or official
traffic control device.
A.
Vehicles to be parked within marked lines and in conformity with
parking time limits. Where lines have been marked on any street, either
parallel with or leading to the curb, vehicles shall be parked within
such space so as not to project beyond such lines and then only in
conformity with the signs, if any, indicating the length of time such
parking is permitted at that particular place.
B.
Double parking prohibited. No vehicle shall stop, stand or park on
the roadway side of any vehicle stopped, standing or parked at the
edge or curb of a street, highway or avenue, unless it is a commercial
vehicle making deliveries.
C.
Standing or parking in front of a public or private driveway.
(1)
No person shall stand or park a vehicle, whether occupied or not,
in front of a public or private driveway.
(2)
Whenever any police officer receives a written complaint from a citizen that a vehicle is standing or parked in violation of this subsection, such officer is hereby authorized to move such vehicle or require the driver or other person in charge of the vehicle to move the same or to provide for the removal of such vehicle by towing or other means in the same manner as is provided for the removal, impoundment and disposition of abandoned vehicles as provided by Article VI of this chapter.
No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule XIII (§ 288-71), attached to and made a part of this chapter.

No person shall park a vehicle at any time upon any of the parking areas, driveways or private streets or roadways or parts thereof described in Schedule XIIIA (§ 288-71.1), attached to and made a part of this chapter.

A.
Commercial
vehicles shall not be parked on private property within 100 feet of
a residential dwelling, nor shall commercial vehicles be parked on
a public road. This section shall not apply while said vehicles are
actively loading or unloading material or other goods associated with
the business owning or operating the vehicle.
B.
Commercial
vehicle attachments shall not be parked or left unattended on any
public road or in any public parking lot in the City of Newburgh.
C.
Trailer
units shall not be parked or left unattended on any public street
or in any public parking lot in the City of Newburgh except as allowed
by temporary permit for a special event.
D.
For
the purpose of this section, "commercial vehicles" shall include tractor-trailers,
tractor-trailer combinations, semitrailers, privately owned military
vehicles, backhoes, excavators, rollers, tractor cranes, truck cranes,
power shovels, road-building machines, road sweepers, sand spreaders,
buses, or any other vehicle being used for a commercial purpose. For
the purpose of this section, "commercial vehicles" shall not include
pickup trucks or vans used for commercial purposes.
E.
For
the purpose of this section, " commercial vehicle attachments" shall
include snow plows, tank trailers, towable generators, wood chippers,
welders, concrete mixers, portable light towers, water pumps or any
other piece of commercially used equipment that is typically towed
behind, or attached to, a vehicle and does not require registration
with the New York State Department of Motor Vehicles.
F.
For
the purpose of this section "trailer unit" shall include tractor-trailer
units, landscape trailers, car dollies, campers, pop-up campers, truck
campers, travel trailers, fifth wheels, motor homes, toy haulers,
teardrop trailers, stand-up trailers, airstreams, or any other object
customarily drawn by an automobile and equipped for use as a temporary
dwelling or as storage space during travel.
G.
The
provisions of this section shall not apply to commercial vehicles,
commercial vehicle attachments, or trailer units owned or operated
by:
(1)
The City of Newburgh, its agents, or employees in connection with
their respective City-related job duties.
(2)
The agents or employees of any local, state, or federal agency or
municipal corporation in connection with their respective government-related
job duties.
(3)
Contractors or subcontractors actively working on a City-authorized
project.
(4)
Contractors or subcontractors actively working pursuant to a valid
permit issued by any department of the City of Newburgh.
(5)
Contractors or subcontractors of utility owners within the City of
Newburgh while actively working on the investigation, repair, maintenance
or replacement of the respective utility.
(6)
Contractors parked on a public road while actively engaged in landscape
or tree maintenance activities during daylight hours but for a duration
of no more than four hours.
No person shall stop a vehicle upon any of the streets or parts of streets described in Schedule XIV (§ 288-72), attached to and made a part of this chapter.
No person shall stand a vehicle upon any of the streets or parts of streets described in Schedule XV (§ 288-73), attached to and made a part of this chapter.
No person shall park a vehicle between the hours specified in Schedule XVI (§ 288-74) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XVI, attached to and made a part of this chapter.
No person shall stop a vehicle during the times specified in Schedule XVII (§ 288-75) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XVII, attached to and made a part of this chapter.
No person shall stand a vehicle during the times specified in Schedule XVIII (§ 288-76) of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XVIII, attached to and made a part of this chapter.
No person shall park a vehicle for longer than the time limit shown in Schedule XIX (§ 288-77) at any time between the hours listed in said Schedule XIX of any day, unless otherwise indicated, upon any of the streets or parts of streets described in said Schedule XIX, attached to and made a part of this chapter.
No person shall park a vehicle upon any of the streets or parts thereof described in Schedule XX (§ 288-78) except at the angle designated and only within the painted stall lines. On all streets or portions thereof where angle parking is now or shall hereafter be authorized, all vehicles parked thereon shall be parked with the front thereof nearest the curb.

A.
No vehicle shall stop, stand or be parked in an area marked as a
loading zone unless it is actually engaged in the loading or unloading
of merchandise or passengers.
B.
An area shall be marked as a loading zone by the erection of signs
bearing the words "No Parking — Loading Zone".
C.
The locations described in Schedule XXI (§ 288-79), attached to and made a part of this chapter, are hereby designated as loading zones. Each loading zone established pursuant to this section shall be subject to the payment of an annual fee established in Chapter 163 of this Code by September 1 of each calendar year. If such fee is not paid, then the designation of such area as a loading zone shall expire as of September 1 of said year, and the City Clerk shall so notify the Police Department and the Traffic Department to remove all designating signs from the public streets and shall note such expiration in the Clerk's records and shall delete such loading zone from the City Code.
D.
Commercial vehicles may also park in metered parking zones to load
or unload merchandise for a period not to exceed 30 minutes.

A.
No vehicle shall stop, stand or be parked in an area marked as a boat trailer parking zone unless it is towing a licensed boat trailer and displays the permit or sticker issued by the City for the current season pursuant to Chapter 220, Parks and Recreation Areas, of this Code.

B.
An area shall be marked as a boat trailer parking zone by the erection
of signs setting forth the restriction of parking in that area to
vehicles towing boat trailers.
The locations described in Schedule XXII (§ 288-80), attached to and made a part of this chapter, are hereby designated as taxi stands.
The locations described in Schedule XXIII (§ 288-81), attached to and made a part of this chapter, are hereby designated as bus stops.

A.
Police Department. Notwithstanding the provisions of any other section
of this chapter, the following parking spaces are reserved for the
exclusive use of Police Department vehicles:
(1)
Eight parking spaces on the south side of Broadway, beginning at
a point 160 feet east of the intersection of the south side of Broadway
with the east line of Grand Street and ending at a point 250 feet
east of said point.
(2)
One parking space in front of or adjacent to any storefront office
established in furtherance of police duties.
(3)
Three parking spaces on Grand Street in the vicinity of the Youth
Division Office at 21-23 Grand Street.
B.
Press parking. Notwithstanding the provisions of any other section
of this chapter, the following parking spaces are reserved for the
exclusive use of the vehicles with New York press license plates:

(1)
Three parking spaces on the south side of Broadway, in front of 343
Broadway, beginning at a point on the face of the southerly curbline
of Broadway, which is on the northerly projection of the westerly
property line of the lot described on the Tax Map of the City of Newburgh
as Section 34, Block 2, Lot 14, which is 622.2 feet, plus or minus,
measured along the southerly right-of-way line of Broadway east of
the intersection of the easterly right-of-way line of Lake Street
with the southerly right-of-way line of Broadway extending 32 feet,
plus or minus, along the southerly curbface of Broadway.

A.
Legislative
findings. The City Council of the City of Newburgh, New York, hereby
finds that an automobile parking problem exists in the City streets
and school parking lots in the area surrounding Newburgh Free Academy.
This problem is created by the large number of automobiles parked
by students in the parking lot on Gidney Avenue and on these streets
and the congregation of students around the parked cars, thereby causing
traffic congestion, lack of street parking space for local residents,
noise caused by loud music coming from car radios, garbage and litter,
and trespass on private property. It is further found that these are
problems affecting the health, safety and welfare of the people of
this City. This section is intended to remedy these problems by creating
an orderly and equitable parting plan for the affected streets and
parking lots and to enforce parking regulations on certain school
district properties upon request of the school district or other schools
as may be in the best interests of the City of Newburgh.
B.
Unless otherwise provided in this section, no person shall park a vehicle between 9:00 a.m. and 12:00 noon of any day, except Saturdays, Sundays and school holidays, upon any of the streets or parts of streets described in Schedule XXIV (§ 288-82).
C.
Exceptions; parking permits for residents. Parking shall be permitted on the streets mentioned in Schedule XXIV (§ 288-82) hereof by residents of the named streets, except for the parts of the streets designated in Subsection D, which parking areas are reserved for certain students of Newburgh Free Academy. A parking permit, as provided by this section, must always be displayed on the dashboard of a vehicle parked on these streets during the designated times. These permits will be issued by the City Clerk upon such reasonable proof as the City Clerk may require as to the residence and the number of cars owned or used by the applicants. Mid-Hudson Counseling Center shall be allowed a permit for each of its staff members and a maximum of six additional permits. The Christ Lutheran Church of Newburgh shall be issued a reasonable number of permits for use of the staff and members of its congregation. One permit shall be issued for each vehicle owned or used by a resident of the designated street.
D.
Student parking areas. The parking lots, streets or parts of streets described in Schedule XXV (§ 288-83) are reserved for students of Newburgh Free Academy having a parking permit visibly displayed inside the windshield. These permits shall be issued by the principal of Newburgh Free Academy to those students who, in his judgment, are most in need of a parking permit because of employment, for medical reasons or for other hardship. He may require an affidavit or other evidence from a student applicant for a parking permit as to the facts that the student claims entitle him to the permit.
E.
Service or delivery vehicles. The parking prohibitions of this section
shall not apply to service or delivery vehicles which are being used
to provide services or to make deliveries to residents.
F.
Other parking regulations. This section is not intended to supersede
the alternate-side-of-the-street ordinance now in effect or any other
ordinances restricting parking on the streets designated herein.
G.
Validity of permit; misuse unlawful; term. Whenever the conditions
entitling a person to a parking permit under this section no longer
exist, the person holding such a permit shall surrender it to the
issuing authority or its authorized representative. It shall be unlawful
for any person to represent that he is entitled to such a permit when
he is not so entitled, to fail to surrender a permit to which he is
no longer entitled or to park a vehicle displaying such a permit at
any time when the holder of such permit is not entitled to hold it.
No permit issued hereunder shall be valid for more than one year but
may be renewed upon expiration, provided that the conditions for issuance
exist.
H.
Revocation of permit. The City Clerk may revoke a resident permit,
or the principal of Newburgh Free Academy may revoke a student permit,
upon finding that the person to whom it was issued is no longer entitled
to such permit or that such person was never entitled to such a permit.
A.
Notwithstanding the provisions of any other section of this chapter, the parking spaces described in Schedule XXVI (§ 288-84), attached to and made a part of this chapter, are hereby reserved for the exclusive use of handicapped persons.
B.
Issuance of handicapped parking permits.
(1)
In accordance with § 1203-a of the Vehicle and Traffic
Law of the State of New York, the City Manager shall appoint an issuing
agent who shall be responsible for the issuance of parking permits
under this section.
(2)
All handicapped persons shall be entitled to a handicapped parking
permit upon application therefor to the issuing agent and upon compliance
with a list of eligibility requirements which may be obtained from
said agent and shall be in accordance with the guidelines of the State
Advocate for the Disabled.
(3)
The handicapped parking permits shall be in a form prescribed by
the State Department of Transportation.
(4)
The permit shall expire two years from its date of issuance.
(5)
The issuing agent shall keep a record of all handicapped parking
permits that are issued.
(6)
Notwithstanding any other provision of this chapter, any vehicle
displaying a handicapped parking permit issued pursuant to § 1203-a
of the Vehicle and Traffic Law or any vehicle being registered pursuant
to § 404-a of the Vehicle and Traffic Law as being owned
by a severely disabled person may park in any metered parking space
without first depositing or causing to be deposited any coin in said
meter.
C.
All handicapped parking spaces heretofore or hereafter established or added to Schedule XXVI, § 288-84B, and located on a public street shall be established for a period of one year commencing on March 1 of each year. Any space which is not reestablished by ordinance of the Council prior to March 1 of each year shall expire without further action, and the sign designating that space as reserved for handicapped parking shall be removed. Those handicapped parking spaces indicated in Schedule XXVI, § 288-84A, shall be permanently established without an expiration date and shall remain in effect.

D.
Any person desiring to have established a handicapped parking space on a public street serving a residential area or to continue a handicapped parking space which has been established in § 288-84B of Schedule XXVI shall apply to the Council for the establishment or continuation of said space and shall submit with each application a fee as set forth in Chapter 163, Fees, of this Code. Applications for the continuation of a space established in § 288-84B of Schedule XXVI shall be made annually at least 45 days prior to the expiration date set forth in Subsection C of this section.

A.
The City Manager is authorized to designate spaces in the several parking lots and parking garages set forth in Schedule XXVII (§ 288-85) attached to and made a part of this chapter, and owned or operated by the City of Newburgh for the following several categories of use:
(1)
Parking spaces reserved for the exclusive use of designated City
officers.
(2)
Parking spaces reserved for the exclusive use of public officers
and employees.
(3)
Parking spaces reserved for the exclusive use of City, county, state
and federal vehicles on official business.
(4)
Parking spaces reserved for the exclusive use of persons possessing
and displaying a valid handicapped parking permit.
(5)
Parking spaces reserved for the exclusive use of persons who shall
have purchased and who display on the parked vehicle a valid parking
permit issued by the City of Newburgh for the lot in which said vehicle
is parked.
(6)
Parking spaces subject to metered parking.
(7)
Parking spaces available for free unrestricted public parking.
B.
The City Manager is authorized to establish time restrictions on
the parking in City parking lots and parking garages, including but
not limited to providing when metered parking or permit parking shall
be in effect and when such lots shall be open for public use or closed
to the public.
C.
The City Manager may designate areas of said parking lots or parking
garages as no-parking, no-standing, no-stopping or safety zones and
may designate pedestrian crossing areas and provide for the erection
therein of such traffic control devices and regulations as may be
appropriate to facilitate ingress and egress to and from said parking
lots and promote the public safety and convenience.
D.
The City Manager shall, in the exercise of the authority delegated
to him herein, consider the following factors:
(1)
The demand for parking spaces in the area in which the parking lot
or garage is located.
(2)
The peak time of such demand.
(3)
The needs of the business community.
(4)
The needs of City residents.
(5)
The needs of City government and its departments.
(6)
The standards for the provision of handicapped-accessible parking
contained in state and federal law and regulations.
E.
Signs. Signs shall be erected by the Police Department specifically
designating said parking spaces and indicating that the use of said
parking spaces is limited to a particular class of vehicle or individual
or that there is no parking or standing allowed in such spaces.
F.
Prohibition. No person shall park in any parking space designated
under the provisions of this section unless he or his vehicle shall
be within the class to which the parking in said space has been limited.
G.
Towing. Vehicles parked in violation of this section shall be towed
away by the Police Department of the City of Newburgh or its authorized
representatives at the owner's expense.

A.
There shall be alternate-side-of-the-street parking on each and every street of the City upon a declaration of a snow emergency by the City Manager or otherwise pursuant to Article IV of this chapter, except as to snow emergency routes as designated by § 288-88 and except as provided in Subsection A(4) hereof and subject to a prohibition of parking by the City Manager pursuant to § 288-39A; and alternate-side-of-the-street parking shall supersede all parking meter zones or other parking restrictions pursuant to this chapter as set forth below:

(1)
On north-south streets, parking shall be permitted on the east side
of the street only for the twenty-four-hour period commencing from
6:00 p.m. on Monday, Wednesday and Friday of each week and shall be
permitted on the west side of the street only for the twenty-four-hour
period commencing from 6:00 p.m. on Tuesday, Thursday, Saturday and
Sunday of each week.
(2)
On east-west streets, parking shall be permitted only on the north
side of the street for the twenty-four-hour period commencing from
6:00 p.m. on Monday, Wednesday and Friday of each week and shall be
permitted on the south side of the street only for the twenty-four-hour
period commencing from 6:00 p.m. on Tuesday, Thursday, Saturday and
Sunday.
(3)
On all other City streets, the Police Department shall designate the side of the street on which parking shall be permitted on any particular day of the week. As with Subsections A and B hereof, parking shall be permitted on one side of the street on Monday, Wednesday and Friday of each week and on the other side of the street on Tuesday, Thursday, Saturday and Sunday of each week. Permitted parking on each side of the street shall also commence from 6:00 p.m. and shall terminate 24 hours thereafter.
(4)
Notwithstanding any other provision of this section, the provisions of this section shall not apply to the streets or portions of streets set forth in Schedule XXVIII (§ 288-86), attached to and made a part of this chapter.
(5)
The City Manager is authorized to suspend alternate-side-of-the-street parking, as provided for by this section, for holidays or other special occasions, but such suspensions shall not exceed 48 hours at any one time. Prior to suspending the regulation, the City Manager should satisfy himself to the greatest extent possible by consulting the weather forecasts that there will not be any significant snowfall during the period of suspension. Any such suspension shall be declared by him as provided in § 288-41 of this Code.

B.
Seasonal alternate-side-of-the-street parking. No vehicle shall be parked during the months indicated in Schedule XXIX (§ 288-87), attached to and made a part of this chapter, upon the streets or parts of streets described in Schedule XXIX. A declaration of a snow emergency shall supersede this section and the alternate-side provisions of Subsection A of this section shall apply to said streets.

A.
The City shall be divided into two sections, as defined below:

(1)
Section 1: All streets to the south of a line beginning at the
western City line and continuing east on Broadway to the intersection
of Broadway and West Street continuing north on West Street to the
intersection of West Street and South Street continuing east on South
Street to the intersection of South Street and Robinson Avenue/Route
9W and continuing south on Robinson Avenue/Route 9W to the intersection
of Robinson Avenue/Route 9W and Broadway continuing east along Broadway
to the intersection of Broadway and Washington Place and continuing
south along Washington Place to the intersection of Washington Place
and Washington Street and continuing east on Washington Street to
the Hudson River.
(2)
Section 2: All streets to the north of a line beginning at the
western City line and continuing east on Broadway to the intersection
of Broadway and West Street continuing north on West Street to the
intersection of West Street and South Street continuing east on South
Street to the intersection of South Street and Robinson Avenue/Route
9W and continuing south on Robinson Avenue/Route 9W to the intersection
of Robinson Avenue/Route 9W and Broadway continuing east along Broadway
to the intersection of Broadway and Washington Place and continuing
south along Washington Place to the intersection of Washington Place
and Washington Street and continuing east on Washington Street to
the Hudson River.
B.
There shall be alternate-side-of-the-street parking on each and every
street of the City as set forth herein:
(1)
In Section 1 of the City, as described in Subsection A(1) above, vehicles shall only be parked, stopped or left standing on the side of the street having odd building numbers on Mondays between the hours of 8:00 a.m. and 3:00 p.m.
(2)
In Section 1 of the City, as described in Subsection A(1) above, vehicles shall only be parked, stopped or left standing on the side of the street having even building numbers on Tuesdays between the hours of 8:00 a.m. and 3:00 p.m.
C.
The following exceptions shall apply to the requirements set forth in Subsection B above:
(1)
No person shall park, stop or leave standing any vehicle on
the north side of Broadway on Tuesday, Thursday and Saturday, between
the hours of 3:00 a.m. and 6:00 a.m., and on the south side of Broadway
on Monday, Wednesday, Friday and Sunday, between the hours of 3:00
a.m. and 6:00 a.m.

(2)
Vehicles shall only be parked, stopped or left standing on the
sides of William Street, South William Street, Liberty Street and
Mill Street having odd building numbers on Mondays between the hours
of 8:00 a.m. and 11:00 a.m.
(3)
Vehicles shall only be parked, stopped or left standing on the
sides of William Street, South William Street, Liberty Street and
Mill Street having even building numbers on Tuesdays between the hours
of 8:00 a.m. and 11:00 a.m.
(4)
No person shall park, stop or leave standing any vehicle on
the west side of Dubois Street from Broadway to First Street on Monday,
Wednesday and Friday between 8:00 a.m. and 3:00 p.m., and no person
shall park, stop or leave standing any vehicle on the east side of
Dubois Street from Broadway to First Street on Tuesday and Thursday
between 8:00 a.m. and 3:00 p.m. No person shall park, stop or leave
standing any vehicle on the west side of Dubois Street from Third
Street to South Street on Monday, Wednesday and Friday between 8:00
a.m. and 3:00 p.m., and no person shall park stop or leave standing
any vehicle on the east side of Dubois Street from Third Street to
South Street on Tuesday and Thursday between 8:00 a.m. and 3:00 p.m.
(5)
Vehicles shall only be parked, stopped or left standing on the
side of Ann Street between Liberty Street and Mill Street having odd
building numbers on Mondays between the hours of 8:00 a.m. and 11:00
a.m.

Vehicles shall only be parked, stopped or left standing on the
side of Ann Street between Liberty Street and Mill Street having even
building numbers on Tuesdays between the hours of 8:00 a.m. and 11:00

D.
The requirements set forth herein shall not supersede any other regulations
but shall be in addition to the same. Nothing in this section relating
to alternate-side-of-the-street parking shall be construed as prohibiting
physicians, emergency vehicles or any person operating authorized
emergency vehicles during an actual emergency from pursuing, fulfilling
or otherwise performing his or her duties.
E.
The Police Chief or his designated representative may direct the removal and impounding of any vehicle parked in violation of this section. Such removal and impoundment shall be governed by Article VI of this chapter.
F.
Penalties for offenses. For the purposes of § 288.36.1,
each twenty-four-hour period any violation of this section shall continue
is a separate offense. Notwithstanding any other provision of the
City Code of Ordinances and in addition to any other fine or penalty,
any costs or expenses incurred by the City of Newburgh in connection
with the towing or storing of a vehicle shall be paid by the owner
or person entitled to possession of such vehicle prior to the release
of such vehicle to the person entitled thereto.
