For the purpose of this article, the terms used herein are defined
as follows.
MOTOR-DRIVEN VEHICLE
Includes, but is not expressly limited to, minibikes, motor
scooters, mopeds, swamp buggies and snowmobiles and any other motor-driven
vehicle designed primarily for the carrying of a passenger or passengers
not capable of being licensed or registered under Title 39 (Motor
Vehicles) of the State of New Jersey Statutes, as amended, excepting
also from this article such vehicles as are expressly exempt from
registration under Title 39.
It shall be rebuttably presumed that any person under the age
of 15 years who operates a moped without first obtaining a special
permit that is issued by the Department of Motor Vehicles is in violation
of the terms of this article and who resides with his or her parent,
guardian or other person having custody of said person, that said
person under the age of 15 years is operating said moped with the
sufferance and permission of said parent, guardian or other person
having custody. Any person under the age of 17 who operates any other
motor-driven vehicle, any parent, guardian or other person who shall
be deemed to have permitted the operation of a motor-driven vehicle
contrary to provisions of this article shall be deemed in violation
of the provisions of this article and subject to the penalties provided
herein.
Any person under the age of 18 years who shall violate any of
the provisions of this article shall be deemed to be a juvenile delinquent
and may be proceeded against as such.
