There is hereby created, in compliance with the provisions of the Pennsylvania Municipalities Planning Code, Act 247,[1] a Planning Commission to act for and on behalf of the Township of Upper Chichester.

The Planning Commission shall consist of seven persons to be appointed by the Board of Township Commissioners, each member to be a resident of the Township of Upper Chichester. One member of the Commission shall be appointed from each of the five wards of the Township and two members of the Commission shall be at large appointees. Members of the Commission shall be appointed for a term of four years. An appointment by the Board of Township Commissioners to fill a vacancy shall be for the unexpired portion of the term for which such appointment is made. Each member of the Planning Commission shall serve without compensation.
A. 
The Planning Commission shall make an annual written report to the Township Commissioners of its transactions, and, in addition to filing such annual report, the Planning Commission shall make or cause to be made and lay before the Township Commissioners maps and plans of the Township or any portion thereof showing the streets, highways and other natural and artificial features, and also any locations recommended by it for any new public buildings, civic schemes, parkways, parks, playgrounds, streets or highways, or any other public grounds or public improvements, and any widening, extension or relocation of the same, and thereafter, from time to time, the Planning Commission may lay before the Township Commissioners any modification change or supplement to any prior plan or plans. The Planning Commission may also, from time to time, make recommendations to the Township Commissioners with respect to any and all matters and things referred to as aforesaid, and, in so doing, said Planning Commission shall have regard for the present conditions and future needs and growth of the Township of Upper Chichester. Any such maps or plans submitted by the Planning Commission shall not be effective unless and until regularly approved and adopted by the ordinance or resolution of the Township Commissioners of the Township of Upper Chichester, and, further, after such approval and adoption, such maps or plans shall be subject to revision and change from time to time as the Township Commissioners of the Township of Upper Chichester may deem expedient.
B. 
It shall be the duty of the Planning Commission, in due course, to make a report, with its recommendation thereon, with reference to any question or proposal submitted to it by the Township Commissioners of the Township of Upper Chichester, relating it to any matters or things referred to in this section, or any other matter or thing relating to the growth or development of the Township, including any plans for the development of any particular section or tract of land in the Township of Upper Chichester.
In no event shall the expenses of the Planning Commission, including the salaries of such engineer or other employees as may be approved by the Township Commissioners of the Township of Upper Chichester, exceed the amount of appropriation provided for such Planning Commission by the Township Commissioners of the Township of Upper Chichester.

The Planning Commission so established shall be known as "The Planning Commission of the Township of Upper Chichester," and shall have all the rights, powers and duties as provided in the Pennsylvania Municipalities Planning Code, Act 247,[1] and any amendments or supplements, thereto.
