Except as otherwise specifically provided in this chapter, all provisions of Chs. 340 to 348, and § 941.01(1), Wis. Stats., describing and defining regulations with respect to vehicles and traffic, are hereby adopted and by reference made a part of this chapter as if fully set forth herein. Any act required to be performed or prohibited by any statute incorporated herein by reference is required or prohibited by this chapter. Any future amendments, revisions or modifications of the statutes incorporated herein are intended to be made part of this chapter in order to secure uniform statewide regulation of traffic on the highways, streets and alleys of the state.
A. 
State speed limits adopted. Except as otherwise specifically provided in this chapter, the provisions of §§ 346.57, 346.58 and 346.59, Wis. Stats., relating to the maximum and minimum speed of vehicles are adopted as part of this section by reference.
B. 
Exceptions. The Village Board hereby determines that the statutory speed limits on the following streets or portions thereof are unreasonable, unsafe or imprudent and modifies such speed limits under § 349.11, Wis. Stats., as follows:

C. 
Public park speed limits. No person shall drive a vehicle at a speed in excess of 15 miles per hour on any public park roadway.
In the interest of public safety and pursuant to § 349.07, Wis. Stats., the following streets or portions thereof are declared to be through highways, and traffic signs or signals giving notice thereof shall be erected by the Village in accordance with this section.

No person shall park any vehicle for more than 30 minutes on any street in the Village between 2:00 a.m. and 7:00 a.m., except for the period beginning April 1 and ending December 1. No person shall park any vehicle for more than 30 minutes on any municipal parking lot of the Village between 2:00 a.m. and 7:00 a.m.

(a) 
No person shall park any vehicle for more than 30 minutes between 2:00 a.m. and 7:00 a.m. on the following Village streets:

Clay Street along the south side that abuts Peninsula Park.

Railroad Street, both sides, from West Dekora Street to Church Street.
(b) 
Physicians on emergency calls and persons having special written permission from the Police Department are exempt from the terms of this subsection.
E. 
Parking on vacant lots. No person shall park or store any vehicle, including trailers, at any time on any lot of which he is not the owner, either in a residential, manufacturing or business district.
F. 
Fire department property. No person may at any time operate a vehicle upon or park a vehicle upon the property occupied by the Saukville Fire Department, except where authorized to do so by the Saukville Fire Department or Village of Saukville or where the person is conducting business with or on behalf of the Saukville Fire Department or Village of Saukville.

G. 
Parking of vehicles over three tons or 18 feet prohibited.

(1) 
No person shall park any truck, trailer, truck power unit, tractor or bus other than a school bus in excess of three tons gross weight or more than 18 feet in length or having an enclosed area of a height of more than eight feet from the roadway on any street in the Village for a period exceeding 30 minutes, except for the purpose of moving or delivering supplies or commodities to or from a place of business or residence facing thereon.
(2) 
No person shall park any school bus in excess of three tons gross weight or more than 18 feet in length or having an enclosed area height of more than eight feet from the roadway on any street in the Village, except between the hours of 8:00 a.m. and 3:00 p.m., Monday through Friday, or except for the purpose of picking up and discharging passengers.
H. 
Snow emergency regulation.

(1) 
Declaration of emergency. When, in the opinion of the Village President in consultation with the Village Administrator, a snowstorm jeopardizes the public safety and welfare of the Village, the Village President may declare a state of public emergency for the duration thereof. This declaration shall be made through the medium of radio, television or other means of public communication. Such declaration shall specify a time, at least one hour after its promulgation, when the emergency will take effect.
(2) 
The need for implementation of the snow emergency will be the actual occurrence of a snowfall depth greater than three inches, or less if combined with freezing and icing conditions, also the occurrence of an ice storm or freezing rain which would make the public ways difficult to travel.
(a) 
Weather reports issued by the National Weather Service will be taken into account to prepare for anticipated maintenance service.
(b) 
The responsibility for coordinating the number and timing of personnel and equipment for a winter maintenance operation will be primarily with the Public Works Superintendent (or designee). The Police Department, during off hours, will keep watch and assist in notification of the Director of Public Works of needed services.

I. 
Regulations. No person shall park or leave unattended any vehicle of any kind or description upon any Village street during a declared snow emergency. All vehicles shall be promptly removed from Village streets immediately at the time when the declared snow emergency takes effect.
J. 
Parking restrictions for camping trailers, recreational vehicles, trailers and certain other vehicles. No person owning or having control of any camping trailer, boat trailer, mobile home, motor bus, motor home, recreational vehicle, school bus or trailer shall park the same upon any street, highway or public right-of-way of the Village for a period exceeding four days, whether consecutive or in the aggregate, per month. The provisions of this subsection shall not apply to authorized emergency vehicles, and shall not prohibit, nor be deemed to prohibit, the lawful parking of any vehicle described in this subsection upon any street, highway or public right-of-way of the Village specifically designated for such purpose.

K. 
Loading zones. No person shall park, stop, or leave standing any vehicle, whether attended or unattended, except for a period not to exceed 30 minutes during normal business hours while loading or unloading passengers, material or merchandise from such vehicle on the following streets or alleys or parts thereof:

(1) 
That portion of the public alley between 234 East Dekora Street and 256-258 East Dekora Street described as beginning at the northeast corner of the property at 234 East Dekora Street, thence southerly along the east lot line of said property a distance of 34 feet, thence easterly along a line parallel to the right-of-way line of East Dekora Street a distance of 10 feet, thence northerly along a line parallel to the east lot line of said property a distance of 34 feet, thence westerly along a line parallel to the right-of-way line of East Dekora Street a distance of 10 feet to the point of beginning.
Pursuant to the authority granted in § 349.085, Wis. Stats., operators of vehicles shall be required to stop at the Soo line grade crossings on:

Dekora Street, west, when the visual and audible signals have been activated, pursuant to § 346.44, Wis. Stats.
A. 
Class "B" highways. All streets and alleys within the Village, except the following, are hereby designated Class "B" highways and shall be subject to the weight limitations imposed by § 348.16, Wis. Stats.:

B. 
Special and season weight limitations. The Village shall have the authority to impose special or seasonal weight limits to prevent injury to the roadway of any highway, bridge or culvert within the jurisdiction of the Village or for the safety of users of such highway, bridge or culvert and shall be responsible for erecting signs giving notice thereof in accordance with § 349.16, Wis. Stats.
C.

D. 
Other streets.
(1) 
No vehicle, except a motor bus which is not equipped with pneumatic tires or has a combined vehicle load weight exceeding 8,000 pounds, shall be operated or moved on any street or alley in the Village not part of the heavy traffic route designated in Subsection C of this section, except for the purpose of obtaining orders for, moving or delivering supplies or commodities to or from a place of business or residence facing thereon, provided that in no event shall the weight of vehicle and load on such street exceed the limitations of § 348.15 or 348.16(3), Wis. Stats., pertaining to Class "A" highways or deliveries on Class "B" highways.
(2) 
Recreational vehicles for personal use and not for hire shall be excluded from the weight restrictions of Subsection A above.
(3) 
[1]The Public Works Committee may issue a one year renewable variance under the following terms and conditions:
(a) 
Application shall be made on forms provided by the Village Administrator.
(b) 
Applicant shall obtain the written permission and approval of all landowners within 100 feet of the property to which the variance is applied for.
(c) 
A variance may only be granted if the vehicle is parked behind the front setback line of the property on which the variance is applied for.
(d) 
Only one variance may be granted per household per year.
(e) 
Any vehicle granted a variance shall be excluded from on street parking during the summer months.
(f) 
Any vehicle granted a variance shall provide a method of heating the engine during the winter months. Running of engines for the purpose of keeping them warm shall be strictly prohibited.
(g) 
Any violation of this subsection shall result in immediate revocation of the variance permit and make the violating party subject to a penalty as provided in § 1-19 of this Code.

The operator of any vehicle involved in an accident shall immediately after such accident file with the Village Police Department a copy of the report required by § 346.70, Wis. Stats., if any. If the operator is unable to make such report, any occupant of the vehicle at the time of the accident capable of making such report shall comply with this section. Such reports shall be subject to the provisions and limitations in §§ 346.70(4)(f) and 346.73, Wis. Stats.

A. 
Public Works Superintendent authorized to procure and erect signs and signals. The Public Works Superintendent shall procure, erect and maintain appropriate standard traffic signs, signals and markings conforming to the rules of the State Department of Transportation giving such notice of the provisions of this chapter as required by state law. Signs shall be erected in such locations and manner as the Village shall determine will best effect the purposes of this chapter and give adequate warning to users of the street or highway.
B. 
Removal of unofficial signs and signals. The Public Works Superintendent shall have the authority granted by § 349.09, Wis. Stats., and shall order the removal of a sign, signal, marking or device placed, maintained or displayed in violation of this chapter or § 346.41, Wis. Stats. Any charge imposed on a premises for removal of such an illegal sign, signal or device shall be reported to the Village Board at its next regular meeting for review and certification.
A. 
Vehicle abandonment prohibited. No person shall leave unattended any motor vehicle, trailer, semitrailer or mobile home on any public street or highway or public or private property, for such time and under such circumstances as to cause the vehicle to reasonably appear to have been abandoned. When any such vehicle has been left unattended on any Village street or highway or on any public or private property within the Village without the permission of the owner for more than 48 hours, the vehicle is deemed abandoned and constitutes a public nuisance.
B. 
Removal and impoundment. Any vehicle in violation of this section shall be impounded until lawfully claimed or disposed of under Subsection C, except that if the Police Chief or his representative determines that the cost of towing and storage charges for the impoundment would exceed the value of the vehicle, the vehicle may be junked by the Village prior to expiration of the impoundment period upon determination by the Police Chief or his representative that the vehicle is not wanted for evidence or other reason.
C. 
Disposal.
(1) 
If the Police Chief or his duly authorized representative determines that the value of the abandoned vehicle exceeds $100, he shall notify the owner and lienholders of record by certified mail that the vehicle has been deemed abandoned and impounded by the Village and may be reclaimed within 15 days upon payment of accrued towing, storage and notice charges and, if not so reclaimed, shall be sold.
(2) 
If an abandoned vehicle determined to exceed $100 in value is not reclaimed within the period and under the conditions as provided above, it may be sold by auction or sealed bid. The description of the vehicle and the terms of the sale shall be posted five days before the sale.
(3) 
After deducting the expense of impoundment and sale, the balance of the proceeds, if any, shall be paid into the Village treasury.
(4) 
Any abandoned vehicle which is determined by the Police Chief or his duly authorized representative to have a value of less than $100 may be disposed of by direct sale to a licensed salvage dealer upon determination that the vehicle is not reported stolen.
D. 
Owner responsible for impoundment and sale costs. The owner of any abandoned vehicle, except a stolen vehicle, is responsible for the abandonment and all costs of impounding and disposing of the vehicle. Costs not recovered from sale of the vehicle may be recovered in a civil action by the Village against the owner.
E. 
Notice of sale or disposition. Within five days after the sale or disposal of a vehicle as provided in Subsection C, the Police Chief or his representative shall advise the Wisconsin Department of Transportation, Division of Motor Vehicles, of such sale or disposition on a form supplied by the Division. A copy of such form shall be given to the purchaser of the vehicle, and a copy shall be retained on file in the Village.
A. 
Junked vehicles prohibited. No disassembled, dismantled, junked, wrecked, inoperable and/or unlicensed motor vehicle shall be stored or allowed to remain in the open upon public or private property within the Village in excess of 48 hours, unless it is in connection with an automotive sales and repair business located in a properly zoned area.
B. 
On public property. Whenever the Police Department finds any such vehicle placed or stored in the open upon public property within the Village, the Department shall cause such vehicle to be removed or stored in a junk or salvage yard or other suitable place for a period of 30 days. The Police Department shall notify the owner thereof of their actions, if the name and whereabouts of the owner of the vehicle can be readily ascertained. At the end of such time such vehicle shall be disposed of unless previously claimed by the owner. If such vehicle is claimed by the owner, all reasonable charges for handling and storage shall be paid by the owner.
C. 
On private property. Whenever the Police Department finds any such vehicle placed or stored in the open upon private property within the Village, they shall notify the owner of the property upon which the vehicle is placed or stored of the intention of the Village to remove such vehicle. If any such vehicle is not removed within 10 days after such notice, the Police Department shall cause such vehicle to be removed, the cost of such removal to be charged to the owner of the property from which it is removed, and the charges shall be entered as a special charge on the tax roll. Upon removal, the vehicle shall be stored in a junk or salvage yard or other suitable place for 30 days, and the owner thereof shall be notified of its whereabouts, if the name and whereabouts of the owner can be readily ascertained. At the end of such time, such vehicle shall be disposed of unless previously claimed by the owner. If such vehicle is claimed by the owner, all reasonable charges for handling and storage shall be paid by the owner.

No person shall erect, construct, maintain, locate or use any semitrailer, whether operative or inoperative, or any cargo, shipping or similar container in the Village for the purpose of storage, warehousing or as the location for the operation of any business. This section shall not apply to parking in a properly zoned area for temporary periods while awaiting unloading.
No person shall permit a motor vehicle in his custody to stand or remain unattended in any street, alley or in any other public place, except an attended parking area, unless either the starting lever, throttle, steering apparatus, gear shift or ignition of the vehicle is locked and the key for such lock is removed from the vehicle. Police, fire and ambulance vehicles are exempt from this section.
A. 
Definition. Bicycle means and includes a light vehicle having two wheels, usually tandem, neither of which shall be less than 20 inches in diameter, with tires inflated, having a steering wheel and a saddle seat or seats, and propelled by the feet acting on treadles connected with cranks or levers.
B. 
License required. No person shall operate or use a bicycle operated alone or in part by muscular power upon any of the streets, alleys or public highways of the Village without first obtaining a license therefor and unless such bicycle is properly registered and tagged.
C. 
Application. Application for a license shall be made to the Police Department upon blanks provided by such Department. The application shall be signed by the applicant and contain the name and address of the owner, together with a complete description of the bicycle. The application shall be presented to the Police Department at which time proper inspection shall be made by Police personnel for compliance with Subsections B, C and D of this section and safe mechanical condition. Statement as to compliance and mechanical condition shall be entered upon the reverse side of the application and signed by police personnel. The Police Department shall refuse registration of any bicycle that is in an unsafe mechanical condition. Upon proper application, statement of compliance and mechanical condition, and payment of a license fee to the Police Department, the bicycle license, which shall be nonexpiring, shall be issued. Such license, when issued, shall entitle the licensee and authorized person, after a corresponding registration card and license tag has been secured, to operate such bicycle upon the streets, alleys and public highways, exclusive of the sidewalks thereof, in the Village. The Police Department shall keep a record of the date of issuance of each license, to whom issued and the number thereof. Registration shall be serially numbered and kept on file at the Police Department.
D. 
Issuance of tag. After payment of the required fee, the Police Department shall issue a license tag which shall be affixed to the rear of the frame of the bicycle in a conspicuous place and shall remain so affixed until re-registration or removal by a Village law enforcement officer for cause. In case of theft or loss of the tag, a duplicate tag shall be issued upon payment of a fee covering the actual cost of such tag.
E. 
License fees. The license fee, in an amount as set by resolution of the Village Board, shall be paid in advance at the time of issuance of the license to the Village Treasurer, and such license may be transferred, except that only one transfer shall be allowed each year. All license fees collected under this section shall be paid into the general fund of the Village. Duplicate license plates shall be issued by the Police Chief when an original is lost, destroyed or stolen, upon payment of a fee in an amount as set by resolution of the Village Board covering the actual cost of such tag.

F. 
Plates not to be mutilated. No person shall willfully or maliciously remove, destroy, mutilate or alter the number of any bicycle frame license pursuant to this section. Within seven days after any bicycle registered hereunder shall change ownership or be dismantled and taken out of operation, the person in whose name the bicycle has been registered shall report such information to the Chief of Police. No person shall remove, destroy, mutilate or alter any license plate, seal or registration card during the time in which such license plate, seal or registration card shall operate.
G. 
General regulations and equipment. Every license issued hereunder shall be deemed to be granted subject to the following conditions:
(1) 
Local and state laws. Every person propelling or riding a bicycle upon a public roadway shall be subject to the provisions of all ordinances and state laws applicable to the operator of any vehicle, except those provisions with reference to equipment of vehicle and those provisions which by their nature would have no application.
(2) 
Light required for night operation. Every bicycle operated upon the streets and public highways of the Village during the nighttime shall be equipped with a lamp on the front emitting a white light visible from a distance of at least 500 feet to the front and with a red reflector on the rear so mounted and maintained as to be visible for a distance of 50 feet to 300 feet to the rear when directly in front of lawful upper beams of head lamps on a motor vehicle. A lamp emitting a red light visible from a distance of 300 feet to the rear may be used in addition to the red reflector.
(3) 
Brake required. Every bicycle, when operated upon a highway, shall be equipped with a brake which will enable the operator to make the braked wheels skid on dry, level, clean pavement. Such brake shall be maintained in good working order at all times.
(4) 
Audible signal device required. Every bicycle, when operated upon a highway, shall be equipped with a bell or other device capable of giving a signal audible for a distance of at least 100 feet, but a bicycle shall not be equipped with, nor shall any person use upon a bicycle, any siren or whistle.
(5) 
Operation on public property prohibited. No bicycle shall be operated upon any public sidewalk, pedestrian paths in the public parks or any public school grounds or public playgrounds. This section shall not apply to such bicycles when operated on school grounds or playgrounds during festival parades or other activities, nor to bicycles which have wheels, with tires inflated, with an overall diameter of 20 inches, when operated by children 10 years of age or under.
(6) 
Bicycles to be on right side of roadway. Every person operating a bicycle upon a roadway shall ride as near to the right side of the roadway as practicable, exercising due care when passing a standing vehicle or one proceeding in the same direction.
(7) 
Bicycles to be operated single file. Every person when operating a bicycle shall do so in single file only, and at no time shall bicycles be operated two or more abreast.
(8) 
Rider to be on seat. A person propelling a bicycle shall not ride other than upon or astride a permanent and regular seat attached thereto.
(9) 
Bicycles not to be propelled by moving vehicle. No person riding a bicycle shall cling or attach himself or his bicycle to any other moving vehicle upon a street or highway.
(10) 
Bicycles to carry only number of persons it was designed for. The operator of a bicycle shall not carry more persons at one time than the number for which it is designed and equipped when operating such bicycle upon any highway in the Village, nor shall the operator of any such bicycle tow or draw any coaster, sled, person on roller skates, toy vehicle or other similar vehicle on a public highway.
(11) 
Not to race. No person operating a bicycle upon a public highway shall participate in any race, speed or endurance contests with any other vehicle.
(12) 
Rider to maintain control of bicycle. No rider of a bicycle shall remove both hands from the handlebars or feet from the pedals, or practice any acrobatic or fancy riding on any street, nor carry any package, bundle or article which prevents the operator from keeping at least one hand upon the handlebars and at all times maintain control of the bicycle.
(13) 
Rider to obey traffic control signals and laws. Every person operating a bicycle upon a public highway shall stop for all arterial highways and automatic traffic signals.
H. 
Authority of police officers. Any police officer shall have authority to suspend the registration card of and remove the license tag from any bicycle operated contrary to this chapter or any state law or Village ordinance, for not to exceed 10 days. Such suspension or removal shall be in addition to other penalties provided under this chapter.
I. 
Play vehicles not to be used on roadway. No person riding upon any coaster, roller skates, sled, toboggan or toy vehicle shall attach the same or himself to any vehicle upon a roadway or go upon any roadway except while crossing a roadway at a crosswalk.
J. 
Responsibility of parent or guardian for violations. No parent or guardian of any child shall authorize or knowingly permit such child to violate any of the provisions of this section.
K. 
New owners to be reported to Chief of Police. It shall be the duty of every person who sells or transfers ownership of any bicycle to report such sale or transfer to the Chief of Police.
A. 
All school buses shall use their flashing red warning lights while loading or unloading pupils or other authorized passengers upon all streets, highways and roadways in the Village.
B. 
All school bus operators shall bring their vehicle to the far right-hand side of the street, highway or roadway when loading or unloading pupils or other authorized passengers within the Village.

No person shall operate an automobile, dune buggy, motor vehicle, four-wheel drive vehicle or other similar motorized wheel vehicle, but not including an all-terrain vehicle (ATV), upon the Milwaukee River when it is in an iced condition in accordance with § 30.81, Wis. Stats.

Except as otherwise specifically provided, the statutory provisions describing and defining regulations with respect to snowmobiles in the following enumerated sections of the Wisconsin Statutes are hereby adopted by reference and made part of this chapter as if fully set forth herein. B. 
Snowmobile routes designated.
(1) 
Except as provided in §§ 350.02 and 350.03, Wis. Stats., no person shall operate a snowmobile upon any public right-of-way, in any public park, golf course or on any other public property in the Village, except on designated snowmobile areas.

(2) 
Snowmobiles operated on designated snowmobile routes over public highways shall observe the rules of the road for motor vehicles set forth in Ch. 346, Wis. Stats., and this chapter. Any act required to be performed or prohibited by such laws is required or prohibited by this section.
C. 
Additional regulations.
(1) 
Speed. No person shall operate a snowmobile upon any public right-of-way or highway within the Village at a speed in excess of that permitted or posted for other motor vehicles.

(2) 
Unattended vehicles. No person shall leave or allow a snowmobile owned or operated by him to remain unattended on any public highway or property while the motor is running or with the starting key left in the ignition.
(3) 
Operation on sidewalks or malls prohibited. No person shall operate a snowmobile on any sidewalk, pedestrianway or mall within the Village.
(4) 
Operation on private premises restricted. No person shall operate a snowmobile on any private property not owned or controlled by him without the express consent or permission of the owner.
(5) 
Snow cover. No person shall operate a snowmobile in the Village in any previously designated area in the absence of an average snow cover in that area of less than three inches.
D. 
Accidents and accident reports.
(1) 
If he can do so without serious danger to his own snowmobile or to persons on board, the operator of a snowmobile involved in a snowmobile accident within the Village shall stop his snowmobile and render to other persons affected thereby such assistance as may be practicable and necessary to save them from or minimize any danger caused by the accident and shall give his name, address and identification of his snowmobile to any person injured and to the owner of any property damaged in the accident.
(2) 
If the snowmobile accident results in death or injury to any person or total property damage in excess of $200, every operator of a snowmobile involved in such accident shall, as soon as possible, notify the Police Department of the accident and shall, within 10 days after the accident, file a written report thereof with the Department on forms prescribed by it.
(3) 
If the operator of a snowmobile is physically incapable of making the report required by this section and there was another occupant in the snowmobile at the time of the accident capable of making the report, he shall make the report.
(4) 
"Snowmobile accident" means a collision, accident or other casualty involving a snowmobile.
E. 
Snowmobile renters licensed.
(1) 
No person shall engage in the business of renting or leasing snowmobiles to the public or renting or leasing the use of a snowmobile track or other private property to the public for the operation of snowmobiles thereon in the Village unless he has a license therefor as provided in this section.
(2) 
Application for snowmobile renters' licenses shall be filed with the Clerk and shall include the name of the owner of the premises on which the business will be conducted, the proposed period and hours of operation, the name of the person conducting the business, the state registration number of the commercial owner, if any, and the registration numbers of any snowmobiles to be rented by the business and such other information as the Village Board may require to consider the application. The application shall be accompanied by a fee in an amount as set by resolution of the Village Board, which shall be refunded to the applicant if the license is denied.

(3) 
No license shall be issued unless approved by the Village Board after a public hearing on the application. Notice of such hearing shall be given by publication of a Class 1 notice under Ch. 985, Wis. Stats. The Board shall approve issuance of the license only if it determines that the public health, safety and welfare will not be adversely affected thereby and that the following terms and conditions are met:
(a) 
The applicant shall file proof of liability insurance in force covering the premises to be licensed and any snowmobile to be rented or offered for use to the public by the applicant with limits of $50,000/$300,000/$10,000.
(b) 
The use of the premises shall conform to the requirements of the zoning regulations of the Village and be approved by the Building Inspector.[1]

(c) 
Snowmobiles shall be operated on the premises or leased for off-premises operation only between 7:00 a.m. and 11:00 p.m.
(d) 
The licensing period shall be for one year from July 1 to June 30. A reduction of up to 50% in the license fee may be granted by the Board for original licenses granted after June 30, but no reduction or refund of the fee shall be granted for any other reason.
(e) 
The Clerk shall issue a renewal license to any person holding a valid license under this section upon payment of the annual license fee; provided, however, that any such applicant who has been convicted within the preceding 12 months of violation of this section or any state statute regulating or restricting the use of snowmobiles or snowmobile renters shall not be entitled to license renewal until renewal is approved by the Board after public hearing as required under this section.
F. 
Public nuisance. No person shall operate any snowmobile at such times or in such a manner or without proper muffler equipment so as to create a public nuisance.
The penalty for violation of any provision of this chapter shall be a forfeiture and penalty assessment if required by § 757.05, Wis. Stats., a jail assessment if required by §302.46(1), Wis. Stats., plus any applicable fees prescribed in Ch. 814, Wis. Stats.
A. 
State forfeiture statutes. Any forfeiture for violation of § 192-1 shall conform to the forfeiture permitted to be imposed for violation of the statutes adopted by reference, including any variations or increases for subsequent offenses.
B. 
Local regulations. Except as otherwise provided in this chapter, the penalty for violation of this chapter shall be as provided in § 1-19 of this Code.
C. 
Parking violations.

(2) 
All persons charged with a nonmoving traffic violation shall be subject to § 345.28, Wis. Stats., as may be amended, revised or modified. Such person may pay the applicable amount of forfeiture to the Police Department within 28 days of issuance of the violation citation. In such event, the citation shall not be filed in court. If the alleged violator fails to pay the applicable amount of forfeiture or fails to appear in court, the Police Department, by its authorized representative, may proceed to issue a summons or may notify the Department of Transportation that a citation has been issued and remains unpaid. In the latter case, the Police Department may request suspension of the registration of the vehicle involved or request that registration be refused of any vehicle owned by the person under § 341.10(7m), Wis. Stats., or both.
A. 
Enforcement procedure. This chapter shall be enforced according to § 23.33, 66.12, 345.11 to 345.61, 350.17 and Ch. 799, Wis. Stats.
B. 
Deposit.
(1) 
Any person arrested for a violation of this chapter may make a deposit of money as directed by the arresting officer at the police station, at the office of the Clerk of Court or by mailing the deposit to such places. The arresting officer or the person receiving the deposit shall notify the arrested person, orally or in writing, that:
(a) 
If the person makes a deposit for a violation of a traffic regulation, the person need not appear in court at the time fixed in the citation, and the person will be deemed to have tendered plea of no contest and submitted to a forfeiture and penalty assessment if required by § 757.05, Wis. Stats., a jail assessment if required by § 302.46(1), Wis. Stats., plus any applicable fees prescribed in Ch. 814, Wis. Stats., not to exceed the amount of the deposit that the court may accept as provided in § 345.37, Wis. Stats.
(b) 
If the person fails to make a deposit for a violation of a traffic regulation or appear in court at the time fixed in the citation, the court may enter a default judgment finding the person guilty of the offense or issue a warrant for his arrest.
(2) 
The amount of the deposit shall be determined in accordance with the deposit schedule established by the Wisconsin Judicial Conference and shall include the penalty assessment established under § 757.05, Wis. Stats., a jail assessment if required by § 302.46(1), Wis. Stats., and costs. If a deposit schedule has not been established, the arresting officer shall require the alleged offender to deposit the forfeiture established by the Chief of Police, which shall include the penalty assessment established under § 757.05, Wis. Stats. Deposits for nonmoving violations shall not include the penalty assessment.
(3) 
The arresting officer or the person receiving the deposit shall issue the arrested person a receipt therefor as required by § 345.26(3)(b), Wis. Stats.
C. 
Petition to reopen judgment. Whenever a person has been convicted in this state on the basis of a forfeiture of deposit or a plea of guilty or no contest and the person was not informed as required under § 345.27(1) and (2), Wis. Stats., the person may, within 60 days after being notified of the revocation or suspension of the operating privilege, petition the court to reopen the judgment and grant him an opportunity to defend on merits. If the court finds that the petitioner was not informed as required under § 345.27(1) and (2), the court shall order the judgment reopened. The court order reopening the judgment automatically reinstates the revoked or suspended operating privilege.

No person shall use motor vehicle brakes within the Village limits of the Village of Saukville which are in any way activated or operated by the compression of the engine of any such motor vehicle or any unit or part thereof. Exceptions allowed are emergency situations.
