It shall be unlawful for any person, firm or corporation or any agent thereof to place, throw, store, accumulate or maintain or cause to be placed, thrown, stored, accumulated or maintained any used cans, papers, boxes, lumber, rubbish, debris, animal matter, garbage or other empty containers, unused or unrepaired appliances, or any other trash or discarded items, upon any property within the Borough of Verona, including but not limited to alleys, highways, yards, lawns or riverbanks, which would cause a nuisance or health hazard to the residents of the Borough. All solid waste must be stored and accumulated pursuant to the Borough's rules and regulations for regular collection of same.
The Borough, through its employees who are law enforcement officers, is hereby empowered to inspect any property to ascertain compliance with the provisions of this article. If noncompliance with the provisions of this article constitutes a nuisance or poses a threat to the health, safety or welfare of the public, said law enforcement officer shall be authorized to institute the appropriate legal proceedings in summary cases.
If the owner or occupant does not remove the trash or litter or otherwise abate the conditions within 10 days of when a citation is issued or notice to comply is otherwise given, the Borough shall have the authority to take measures to correct the conditions and collect the cost of such corrections plus 10% of all costs and place a municipal claim on said property for the cost of the abatement. The Borough, in such event and pursuant to its statutory or otherwise authorized police powers, shall have the right and power to enter upon the offending premises to accomplish the foregoing.
Any person who shall violate any provision of this article shall, upon conviction thereof or upon entering a guilty plea, pay a fine of $50 plus costs of prosecution. Each day that a violation of this article continues shall constitute a separate offense.
The remedy of abatement for the enforcement of this article or any remedy provided by law shall not be deemed mutually exclusive; rather they may be employed simultaneously or consecutively, at the option of the Borough, and employment of such remedy does not preclude the imposition of a fine as set forth above.
