[Amended 11-10-1998 by Ord. No. 9-1998]
A.Â
Any person, firm or corporation who violates any provisions of this
chapter shall, upon being found liable therefor in a civil enforcement
proceeding, pay a judgment of not more than $500 plus all court costs,
including reasonable attorney's fees incurred by the Borough as a
result thereof. Each day that a violation continues shall constitute
a separate violation, unless the Magisterial District Judge determining
that there has been a violation further determines that there was
a good faith basis for the person, partnership or corporation violating
the ordinance to have believed that there was no such violation; in
which event, there shall be deemed to have been only one such violation
until the fifth day following the date of determination of a violation
by the Magisterial District Judge, and thereafter each day that a
violation continues shall constitute a separate violation.
B.Â
The owner or tenant of any building, structure, premises or part
thereof, and any architect, contractor, agent or other person who
commits, participates in, assists in or maintains such violation,
may each be found liable of a separate offense and suffer the penalties
herein provided.
D.Â
Nothing herein contained shall prevent the Borough from taking such
other lawful action as may be necessary to prevent or remedy any violation
or to bring an action to enjoin any violation of this chapter.
