No dwelling, apartment or other livable quarters may be occupied when previously vacated unless the owner or landlord of said property shall first apply for and obtain an occupancy permit to be issued by the Borough Building Inspector.
An application for the permit referred to in § 110-1 shall be formulated by the proper officials of the Borough, on which form the following information, but not limited thereto, shall be requested from the said landlord or owner thereof:
A. 
Name of owner of premises and agent, if any.
B. 
Name of tenant within 30 days after occupancy.
C. 
Location of premises.
D. 
Number of rental units.
E. 
Bathroom facilities per unit.
F. 
Number of occupants.
G. 
Condition of house.
H. 
Condition of heating system.
I. 
Fire escape if more than two floors: yes or no.
No permit shall be issued for occupancy unless the premises shall be in livable and habitable condition and after having been inspected by the Fire Chief and Building Inspector and/or such other officials as the Council may require from time to time.
The fee for the issuance of said permit shall be $2, 1/2 of which shall be paid to the Building Inspector as compensation for his services.

Any person, firm, association or corporation who or which shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine of not more than $300 and costs of prosecution, or, in default of payment of such fine and costs, to undergo imprisonment for not more than 30 days.
