The procedure for each applicant desiring to obtain the vacation of streets and roads by the Township Committee shall be as follows:
A. 
Application shall be made in writing on forms provided by the Township of Jackson, and said application shall include a map or sketch of the streets and roadways requested to be vacated.
B. 
Said application, supporting documents and information shall be submitted to the Township Clerk, together with a fee of $150 to defray administrative costs and direct expenses. In addition, the application shall contain the applicant's agreement to defray all engineering costs and expenses caused to the Township of Jackson.
In the event that the Township Committee, in its discretion, fails to adopt an ordinance vacating streets in accordance with any submitted application, the fee paid to the Township shall be returned to the applicant, less any actual costs, expenses or professional fees incurred by the Township of Jackson.
