The following terms shall have the meanings indicated:
As defined in the Liquor Code of the Commonwealth of Pennsylvania
(i.e., liquor, wine, malt, and brewed beverages).
Any container from which consumption of an alcoholic beverage
is occurring.
Any public street, alley, sidewalk, park, playground, ballfield,
recreation areas, commons, or parking lots; or any private parking
lots open to public use (regardless of if the private parking lot
establishment is open or closed for business).
Includes but is not limited to the following types of activities:
a neighborhood block party, barbecue, picnic, fundraiser, community
event or any other type of similar social event.

It shall be unlawful for any person to drink an alcoholic beverage
upon any public access property within the Borough, and it shall be
unlawful for any person to have in such person's possession, or in
a vehicle under such person's control, any open container containing
an alcoholic beverage upon any public access property in the Borough.

Any restaurant establishment that provides inside seating for dining purposes for 30 or more patrons that would like to include outside seating for dining purposes will have the option to have open containers, as defined in § 801 of this Part 8, outside of the establishment. The allowable area to have open containers shall be limited to within the confines of the establishment's side lot lines and from the front of the establishment to an area five or more feet back from the curbline to enable access for the public right-of-way.

Any person or group wanting to hold a special event that will
include open containers, as defined in § 801 that will be
held on or involve Public Access Property as defined in § 801
will also need to first apply for an open container permit from the
Zoning Officer before holding the event. The permit will establish
certain boundaries in which open containers are allowed and will also
establish a time limitation for that permit.

Any person who shall violate the provisions of this Part 8,
shall upon conviction thereof, be sentenced to pay a fine of $50 plus
the costs of prosecution, or in default of payment of same, to undergo
imprisonment for five days for the first offense; $100 plus the costs
of prosecution, or in default of payment, imprisonment for 10 days
for the second offense; and $300 plus the costs of prosecution, or
in default of payment, imprisonment for 90 days for the third offense
and any offense thereafter.

Any police officer is hereby authorized to act on behalf of
the Borough.
