A. 
In accordance with the Charter, the City Manager shall be chosen by the Council on the basis of administrative experience and qualifications. The City Manager need not be a resident of the City or state at the time of appointment.
B. 
The City Manager shall not hold any elective governmental office.
C. 
The City Manager shall be appointed for an indefinite term and may be removed as set forth in the Charter.
The City Manager shall be the Chief Administrative and Operating Officer of the City and shall have all the powers, duties and responsibilities set forth in the Charter. The City Manager may, where appropriate, delegate specific duties to those under his/her administrative supervision. The City Manager shall retain responsibility even where duties are delegated. Specifically, he/she shall have the following powers and duties:
A. 
Appoint and suspend or remove all City employees and appointive administrative officers provided for, by, or under the Charter, except as otherwise provided by law, this Charter or personnel rules adopted pursuant to this Charter. The City Manager shall appoint the directors of departments. The City Manager may authorize any administrative officer subject to the City Manager's direction and supervision to exercise these powers with respect to subordinates in that officer's department, office or agency. The City Manager shall annually submit a human resources manual to the City Council for approval.
B. 
Direct and supervise the administration of all departments, offices, and agencies of the City, except as otherwise provided by this Charter or by law.
C. 
Attend all City Council meetings. The City Manager shall have the right to take part in discussion but shall not vote.
D. 
Prepare the annual budget and any necessary capital budget as may be required by the Administrative Code set forth in Article II, § 7-12H, for the Mayor and the City Council, and implement the final budget approved by Council to achieve the goals of the City.
E. 
Submit to the Mayor and City Council, and make available to the public, a complete report on the finances and administrative activities of the City at the end of each fiscal year.
F. 
Make such other reports as the City Council may require concerning operations and recommend plans, performance measures, and bench marks to the Mayor to be included in the annual "State of the City and Its Government" message.
G. 
Keep the Mayor and City Council fully advised as to the financial condition and future needs of the City.
H. 
Provide staff support services for the Mayor and Council members.
I. 
Perform such other duties as are specified in this Charter or may be required by the City Council, including but not limited to the faithful execution of all laws, provisions of this Charter, and acts of the City Council.
J. 
Work with the City Finance Director to establish and maintain a uniform accounting system throughout the City government. Such system shall be designed to accurately reflect the assets and liabilities and the income and expenses of the City and shall control all expenditures by an encumbrance system.
K. 
Be a member, ex-officio, of such authorities, boards, commissions, and other operating or advisory boards to the City Council as directed by City Council. As such ex-officio member, he/she shall have the right to take part in the discussion and deliberations but shall not have the right to vote. The City Manager shall keep Council informed of the planning and activities of all such boards to which he/she is designated a member by City Council. The City Manager shall have the power to designate appropriate staff members to fulfill these functions in lieu of performing them personally with respect to participating boards, authorities and commissions unless City Council directs otherwise.
L. 
Negotiate labor contracts and other contracts on behalf of the City. Such contracts shall be subject to approval by City Council.
M. 
Investigate and dispose of, or designate an officer to investigate and dispose of, all complaints regarding City services. All complaints regarding City services shall be referred to the office of the City Manager.
By written correspondence filed with the Mayor and Council, the City Manager shall designate a City officer or employee to exercise the powers and perform the duties of City Manager during the City Manager's temporary absence or disability.
