[HISTORY: Adopted by the Board of Trustees of the Village of Buchanan 7-12-1982 by L.L. No. 2-1982 (Ch. 7 of the 1971 Code). Amendments noted where applicable.]
The definitions given herein deal only with certain terms used in this chapter, in the sense that they are used herein:
BOAT
Any type of watercraft of any size, whether propelled by oar, sail or motor.
BOAT RAMP
The ramp and surrounding parking area located at Lent's Cove, Buchanan, New York, which was designed and constructed for the purposes of launching and retrieving boats and any and all other types of marine vessels.
BOAT RAMP PERMIT
A permit as required by this chapter.
No person shall launch a boat from the boat ramp without having first obtained a boat ramp permit from the Village Clerk.
Permits shall be issued to both residents and nonresidents as follows:
A. 
Residents of the Village of Buchanan, upon making proper application to the Buchanan Village Clerk, shall be entitled to one permit, provided that they shall meet any and all other criteria imposed by law. There shall be no fee to Village residents to obtain this permit, nor shall there be any limit on the number of permits issued.
B. 
Nonresidents of the Village of Buchanan, upon making proper application to the Buchanan Village Clerk, shall be entitled to a permit, provided that they shall meet any and all other criteria imposed by law and shall pay to the Village Clerk an annual fee in an amount as set from time to time by resolution of the Board of Trustees. There shall be a maximum of 25 nonresident permits issued per year. Permits shall be issued on the basis of the order in which requests are made, and, in the event that more than 25 requests for applications are made during any one season, permits shall only be issued to the first 25 applicants.

C. 
Contents. Each application for a permit shall include the following information:
(1) 
The name, address and telephone number of the applicant.
(2) 
The make, model and license number of the vehicle which will be used to tow any trailers.
(3) 
The make, model and license number of the applicant's trailer.
(4) 
The make, model and identification number of the boat the applicant will launch.
(5) 
The names and ages of any other immediate family members who reside with the applicant and who will also use the permit.
(6) 
Proof of proper insurance as required by law.
A. 
The permit issued pursuant to this chapter is not assignable and may be used only by the holder of the permit and members of his family who reside with the permit holder.
B. 
Should a permit holder be found to have permitted an unauthorized person to use his permit, the permit holder shall have his permit revoked for the remainder of the season.
The Buchanan Village Board shall establish rules and regulations regarding the parking of vehicles and trailers in the parking lot adjacent to the boat ramp and shall lay out parking and standing areas within that part of Lent's Cove. Said area shall be designated by suitable signs, markings and fences indicating the parking restrictions.
A. 
A permittee hereunder shall comply with all permit directions and conditions and with all applicable laws.
B. 
Possession and display of permit. The permittee shall have the permit with him at all times he uses the boat ramp and shall display the permit on said vehicle as required by the terms and conditions of the permit.
The Village Board shall, from time to time, promulgate and enact further rules and regulations regarding the use of the permit so as to ensure the welfare and safety of the same for Village residents.
Any violation of this chapter shall be punishable by a fine not to exceed $100.[1]
