The discharge, firing, exploding or use of firecrackers, rockets, skyrockets, torpedoes, aerial salutes, bombs, roman candles, fire balloons, fireworks, pistols, cannons, blank cartridges or any other device, appliance or contrivance using or containing chlorate of potash mixture, nitrates, oxalates, sulfides of lead, barium, antimony, arsenic, mercury, nitroglycerin, phosphorous or any combustible of explosive composition of any substance or composition of substances or flammable compound or tablet designed or intended to produce a visible or audible pyrotechnic effect by combustion, explosion, conflagration, deflagration or detonation is hereby prohibited within the limits of the Village of Buchanan, except when done under special authority of the Board of Trustees of said Village as hereinafter provided.
The Board of Trustees of the Village of Buchanan, upon written petition addressed to it and filed in the office of the Clerk of the Village, may grant to such person, persons, firm or corporation, as it may determine, from time to time, permission for the display of fireworks and pyrotechnics under such terms as it may prescribe, not inconsistent herewith; provided, however, that in no case shall any such permit be granted unless there shall appear from the written petition for the same the date, time of day when and place where such display is proposed and the name of the person, persons, firm or corporation under whose auspices the same is to be held, together with a general description of the character of fireworks and all other pyrotechnics to be used, and the occasion, reason or purpose of such display; and provided further, however, that in no case shall the use or display thereof continue after the hour of 11:00 p.m.
Any person, firm, copartnership or corporation violating any provisions of this chapter shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished for each offense by a fine not to exceed $50 or by imprisonment in the Westchester County Penitentiary for a term of not to exceed 60 days.
