As used in this article, the following terms shall have meanings
as follows:
An entertainment facility opened to the public which consists of various amusement activities, such as rides, animal attractions, water attractions/rides, shows, and games licensed pursuant to Chapter 92 of the Code of the Township of Jackson.
The burning of, inhaling from, exhaling the smoke from, or
the possession of a lighted cigar, cigarette, pipe or any other matter
or substance which contains tobacco or any other matter that can be
smoked.
Smoking is prohibited on the premises of any amusement park
located in the Township of Jackson.
The owner or operator of an amusement park may designate specific
outdoor areas as smoking areas. Said owner or operator shall conspicuously
post a sign which designates each smoking area. Sufficient signage
shall also be posted throughout the park to inform the public of the
smoking prohibition.
The owner, operator, or person in control of the amusement park,
or designated enforcement official for said persons, shall order a
person smoking in violation of this article to comply with the provisions
of this article. A person who smokes in violation of this article
is subject to a fine of not less than $100 nor more than $250 for
the first offense; not less than $100 nor more than $500 for the second
offense; and not less than $100 nor more than $1,000 for each subsequent
offense.
