It is hereby declared to be a nuisance and it shall be unlawful for any person, firm or corporation to make or cause or suffer or permit to be made or caused upon any premises owned, occupied or controlled by him or it or upon any public street, alley or thoroughfare in the Borough of Bellevue, any unnecessary noises or sounds by means of the human voice or by any other means or methods which are physically annoying to the comfort of any person, or which are so harsh or so prolonged or unnatural or unusual in their use, time and place as to occasion physical discomfort, or which are injurious to the lives, health, peace and comfort of the inhabitants of said Borough of Bellevue.
It shall be unlawful for any person, firm or corporation or their agents or employees engaged in the collection of garbage, rubbish or refuse in the Borough of Bellevue to make any such collections between the hours of 11:00 p.m. and 6:00 a.m., current time, or on any Sunday or legal holiday.
It shall be unlawful for any person, firm or corporation, or their agents or employees, to engage in the moving from one residence or location to another residence or location of furniture, household goods, appliances and other personal effects between the hours of 11:00 p.m. and 6:00 a.m. This prohibition includes but is not limited to the loading and unloading of any vehicle or the opening or sealing of boxes, crates or containers whereby loud and excessive noise is created.
It shall be unlawful for any person, firm or corporation, or their agents or employees, to engage in the moving from one commercial building, storehouse or location to another commercial building or location of commercial goods, packages, crates, boxes or containers between the hours of 11:00 p.m. and 6:00 a.m. This prohibition includes but is not limited to the loading and unloading of any vehicle and the opening or sealing of boxes, crates or containers whereby loud and excessive noise is created.
It shall be unlawful for any person, firm or corporation, or their agents or employees, owning and occupying any building, premises or other place in the Borough of Bellevue, to operate or permit to be operated any type of machinery, appliance, equipment or hand tool which emits noise beyond the premises upon which said machinery, appliance, equipment or hand tool is being operated or used between the hours of 9:00 p.m. and 7:00 a.m., current time. This prohibition applies to construction, repair, alteration and demolition of buildings, and to paving of streets and excavations.
It shall be unlawful for any person, firm or corporation to operate or use any power lawn mower or chain saw between the hours of 9:00 p.m. and 7:00 a.m., current time.
The normal or emergency working activities of township, county, state or federal governmental agencies and emergency activities of any utilities and any volunteer fire company operation within the Borough of Bellevue are exempt from the provisions of this chapter.
Any person, firm or corporation who shall violate any provision of this chapter shall, upon conviction thereof, be sentenced to pay a fine of not less than $50 nor more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this chapter continues shall constitute a separate offense.
