There is hereby established and constituted a Council on Aging in accordance with the provisions of MGL, c. 40, section 8B, under the terms and provisions of this article.

The council established by section 2-95 shall be known as the council on aging.

In accordance with Article 2, Section 2-10, Article 3, Section 3-3 and Article 6 of Chapter 72 of the Acts of 2013, the Mayor shall appoint not less than seven but no more than 21 members to the Council on Aging, as described in MGL c. 40, § 8B, and subject to City Council approval. Each member shall serve a term of three years. The mayor shall have the authority with the approval of the city council to discharge the council on aging, or, at the request voted by the council on aging, to discharge any member of the council on aging. The members of the council on aging shall serve without compensation except that the secretary may be compensated in the amount provided therefor by an appropriation made by the city council.

In the event of a vacancy, the Mayor shall appoint a successor as soon as practicable, subject to city council approval, and said successor shall fulfill the unexpired term of the member whose seat was vacated.

In accordance with Article 10, Section 10-6(a) of the City Charter enacted by Chapter 72 of the Acts of 2013, the council on aging shall organize by electing a chairman, a secretary, and an executive committee on the third Wednesday of each January. Each person so appointed shall serve for a term of one year from the third Wednesday in January in the year of the appointment and until his successor shall be duly appointed and qualified. In addition thereto the council on aging shall organize, establish rules and procedure in such manner as it deems necessary for the proper exercise of its powers and discharge of its duties.

The council on aging shall meet as frequently and at such times and places, within the city, as it may deem necessary for the proper exercise of its powers and discharge of its duties.

A quorum shall consist of a majority of current members or of six members, whichever is less, and when there is a quorum the vote of a majority of those present shall be considered the vote of the council.

The council on aging shall keep a detailed record of its acts and proceedings, and upon the discharge of such council the records shall be filed with the city clerk.

The council on aging shall have the following powers and duties:
(a) 
The council on aging shall carry out programs designed to meet the problems of the aging in coordination with programs of the commission on aging established under the General Laws, chapter 6, section 73, and the duties of such council may include the following:
(b) 
To promote, assist and coordinate activities designed to meet such problems.
(c) 
The determination of the needs of the aging and the provision of those needs.
(d) 
Interpretation to the public of such needs.
(e) 
Counseling services.
(f) 
Cataloging of the problems of the aging.
(g) 
The promotion of the facilities for the health, education, welfare and recreation of the aging.
(h) 
To incur liabilities which shall not be excess of the sums which may from time to time be appropriated for the use of such council.

The council on aging shall have the power and authority to engage or employ any clerical or other assistance which it may require for the discharge of its duties, and to fix, establish and approve the compensation to be paid for such clerical assistance, but not in excess of the sums which may from time to time be appropriated for the use of such council.

All departments, boards and committees of the city having records, information, material or services required by the council on aging in the discharge of its duties shall, if practicable, make the same available to such council; and all such departments, boards and committees shall cooperate with such council in the discharge of its duties.

The council on aging shall submit a written report to the mayor and city council with such frequency and at such times as the mayor and city council may request.
