A conservation commission, hereinafter sometimes referred to in this article as the commission, is hereby established in accordance with the provisions of General Laws, Chapter 40, section 8C.

In accordance with Article 2, Section 2-10, Article 3, Section 3-3 and Article 6 of Chapter 72 of the Acts of 2013, the Mayor shall appoint not less than three but no more than seven members to the Conservation Commission, pursuant to MGL c. 40, § 8C, and subject to City Council approval. The members shall include one member of the city council.

Each member shall serve a term of three years. In the event of a vacancy, the Mayor shall appoint a successor as soon as practicable, subject to city council approval, and said successor shall fulfill the unexpired term of the member whose seat was vacated.

In accordance with Article 10, Section 10-6(a) of the City Charter enacted by Chapter 72 of the Acts of 2013, the conservation commission shall elect annually a chairman and a clerk from among its own number.

In accordance with Article 10, Section 10-6(a) of the City Charter enacted by Chapter 72 of the Acts of 2013, the conservation commission shall exercise and perform all the powers and duties conferred upon conservation commissions by General Laws, chapter 40, section 8C and in addition shall perform such other duties, not inconsistent with such section, as may be imposed by law or ordinance. The commission may make rules and regulations consistent with law and in furtherance of its purpose, and may establish by unanimous vote of all of its members a schedule of fees entitled “Project Review Fee Schedule.” Said fee schedule shall be rationally and directly related to the amount of resources of the commission necessarily used by the commission in reviewing proposed projects which come before the commission. Subject to appropriation, the commission may appoint such clerks and other employees as it may from time to time require. The commission shall have control of the conservation fund set up in accordance with General Laws, chapter 40, section 5, clause (51) and may expend money from such fund for any purpose authorized by section 8C, chapter 40 of the General Laws.
