There is hereby established a municipal board to be known as the “Personnel Review Board of the City of Pittsfield” (hereinafter referred to as the “Board”).

(a) 
It shall be the function and purpose of said Board:
(1) 
To evaluate the duties and compensation in connection with the creation of all new positions in the service of the City;
(2) 
To evaluate the duties and compensation in connection with all upgrades of exempt employees in the service of the City;
(3) 
To evaluate the duties and compensation in connection with all upgrades of union employees in the service of the City outside of the collective bargaining process;
(4) 
To participate in the development of a performance appraisal system, which ensures annual compliance, for all employees in the service of the City; and
(5) 
To review salary studies and/or pay scales of all employees in the service of the City and make recommendations to the Mayor and the City Council in order to maintain fair and equitable pay levels.
(b) 
The Board shall make recommendations to the Mayor and City Council as to whether any such position shall thereafter be created or upgraded, including change of duties or added duties, change of education requirements or added education requirements. The Board’s recommendations shall be merely advisory, and shall be so treated. A report of the Board’s recommendations shall be forwarded forthwith to the Mayor. All changes are subject to City Council approval.

(a) 
The Personnel Review Board shall consist of five members, one of whom shall be the Personnel Director or his/her designee, and the other shall be the Director of Finance/Treasurer or his/her designee. In accordance with Article 2, Section 2-10, Article 3, Section 3-3 and Article 6 of Chapter 72 of the Acts of 2013, the Mayor shall appoint all of the members to the Personnel Review Board subject to City Council approval. The Mayor shall seek to find members with an expertise, who can contribute to the fulfillment of the purposes for which this board has been established. In accordance with Article 10, Section 10-6(a) of Chapter 72 of the Acts of 2013, the members of the Board shall elect a Chairman, Vice Chair and Secretary. Both the Personnel Director or his/her designee and the Director of Finance/Treasurer or his/her designee shall be ex officio voting members. The members who are city officials shall serve as long as they serve in their official capacities. The three remaining members appointed by the Mayor shall serve terms in a manner whereby one member serves a term of four years, the other for a term of three years, and the final member for a term of two years. In the event of a vacancy, the Mayor shall appoint a successor as soon as practicable, subject to city council approval, and said successor shall fulfill the unexpired term of the member whose seat was vacated.

All departments, boards, commissions and committees of the City shall notify said Board immediately upon the creation of a vacancy, or at such time it becomes apparent a vacancy is to be created. All such departments, boards, commissions and committees having records, information, material or services required by the said Board in the discharge of its duties, shall make the same available to such Board and all such departments, boards, commissions and committees shall cooperate with said Board in the discharge of its duties.

The members of the Board shall serve without compensation.
