In order to ensure public safety before and during parades, the following regulations pursuant to MGL c. 10, § 22, are hereby enacted. The Commissioner of Public Services shall designate specified areas for vending along the proposed route of every parade held in the City.

It shall be unlawful for any person to conduct vending activities in conjunction with parades except as follows.

In order for the Commissioner of Public Services to determine the appropriate location of vending areas, the organizers of every parade, including City agencies, shall notify the Commissioner of Public Services and Police Chief, 90 days in advance of the date of parade of the proposed parade route.

The Commissioner of Public Services shall notify interested vendors by publication in a newspaper at least 45 days in advance of the date of a parade that vending areas for that parade have been determined and that the vending areas will be assigned by a lottery by drawing. Said lottery shall be held no sooner than 10 days after the date of publication. Only persons with the proper state licenses as required by MGL c. 101 and City permits as required by ordinance, shall be eligible for the drawing.

All successful applicants for designated vending areas shall pay the City an appropriate amount to defray the costs of the issuance and production of the permit and identification.

The Commissioner of Public Services shall issue a permit for each vending area which will identify the parade, the vending areas, the person granted the permit, and all properly licensed agents of said persons. Each person and all agents to be employed shall be required to wear a visible identification that indicates the parade, the vending area, and the name and address of the person wearing the identification. The identification shall also have a photograph of each person so licensed.

Fifteen minutes before a parade is schedule to begin and during the course of the parade no vending except fundraising by parade organizers shall be allowed within and/or on any roadway, street, or sidewalk, in the course of the parade route; except, all vending during the period shall be conducted at the designated vending areas as described in § 11-33.

The Chief of Police, or his designees, and the Sealer of Weights and Measures, shall enforce this article.
