A petition, including a waiver of liability, for temporary repairs of a private way must be signed by abutters on 51% of the developed linear frontage on said way.

All petitions, sufficient under § 20-81, to the City Council shall be referred to the Committee on Public Services.

The scope of the work shall be determined by the Commissioner of Public Services subject to approval of the Committee on Public Services, and final approval by the City Council.

Repairs shall be limited to grading, patching, the laying of gravel sufficient to effect a uniform grade and repairs necessary for drainage purposes. Repairs shall not include repaving, reconstruction of the roadbed or roadway or removal of existing material.

There shall be no requirement for a finding of public necessity to make temporary repairs under this article.

There shall be no charge levied against the abutter for any temporary repairs under this article.

There shall be a finding made by the Committee on Public Services that the unaccepted way in question shall have been opened to public use for five years or more in order to make temporary repairs under this article. No street shall be eligible for temporary repairs more than once in a three-year period.

The liability of the City for work done under this article is limited to $5,000.

Any inhabited unaccepted street, roadway, or way entirely within the City limits, deemed by the Commissioner of Public Services to be impassable by emergency vehicles, shall be temporarily repaired.

Any inhabited unaccepted street, roadway, or way entirely within the City limits, deemed by the Commissioner of Public Services to have been damaged by a City vehicle or City apparatus, shall be temporarily repaired.

Any person who violates any provision of this chapter shall pay the fines as stated below:
First offense
$50
Second offense
$100
Third offense
$200
Fourth and each subsequent offense
$300
Each day in which any violation exists shall be deemed to constitute a separate offense. The provisions of this chapter shall be enforced by the Buildings Inspectors' office, Department of Public Services and the Police Department.
