There is hereby adopted by the Borough of Mount Union, for the purpose of prescribing regulations governing the installation, construction and inspection of electrical wiring systems, equipment and other facilities utilizing electrical energy for light, heat and power in or on any building, structure or premises in the Borough of Mount Union and of promoting the public welfare and safety, that certain code known as the "National Electrical Code," as published by the National Fire Protection Association, 1978 Edition. No less than three copies of the latest revision of such code have been and are now on file in the office of the Borough Secretary.
A.ย 
Definitions. As used in this article, the following terms shall have the meanings indicated:
ELECTRICAL WIRING SYSTEM
Means and includes all electrical apparatus, electrical wiring, electrical fixtures and electrical supplies used for electrical energy, including but not limited to the electrical wiring and apparatus used in connection with and conjunctive with heating, plumbing, ventilating, air-conditioning, refrigeration and water-heating systems; provided, however, the term shall not include lamps and portable electrical appliances separate from permanently fixed plug-in receptacles.

This article shall not apply to the installation of facilities owned and employed by an electric or communications utility in the exercise of its function to serve the general consumer public as a utility exclusively for providing such utility service. This provision shall not be construed to exempt such utility or company from the requirements of this code for construction or installation not directly connected with the utility service to the public.

Whenever in this article the term "Electrical Inspector" shall be used, such term shall mean the "Borough Code Enforcement Officer," unless otherwise indicated.
All electrical systems installed, constructed, altered or extended within or on public or private buildings or other premises, including yards, carnivals, parking lots, trailers and mobile homes, industrial substations or any other buildings or land, shall in all respects conform to the requirements of the said National Electrical Code. Only those materials, fittings and devices enumerated in said National Electrical Code, and its corresponding "List of Inspected Appliances of the Underwriters Laboratories, Inc.," as herein adopted, shall be used in electrical construction work under this code.
Upon the filing of a written application in such form as the Borough Code Enforcement Officer shall require, and upon payment of the required fee, a permit shall be issued in duplicate to the electrical contractor or other person making application, one copy thereof to be conspicuously posted upon the premises where the work is being done, until the work has been inspected and approved by the Electrical Inspection Department of the Middle Department Association of Fire Underwriters or another electrical inspection service and a certificate of approval, executed by such Electrical Inspection Department or electrical inspection service, filed with the Borough Code Enforcement Officer.
Permits may be granted upon payment of fees in an amount as provided for in the Basic Building Code of the Borough of Mount Union. (See Article II of this chapter.)
A.ย 
Before any electrical contractor or other person doing the electrical installation or construction work for which he has received a permit shall complete such work, he shall make application for inspection on the form used by the Middle Department Association of Fire Underwriters, Electrical Inspection Department, or another approved electrical inspection service, specifying the premises wherein the installation or construction is being done and the extent, specifications and classifications of such work, and shall pay the fees published thereon.
B.ย 
The Electrical Inspection Department of the Middle Department Association of Fire Underwriters or another approved electrical inspection service shall, upon receipt of the inspection application, make or cause to be made an inspection of such work and conduct such test as may be necessary. If the work is done in accordance with the requirements of the Electrical Code, the Electrical Inspection Department or electrical inspection service shall thereupon issue a cut-in card to the local electrical utility office and a rough-wiring or final certificate of approval, as the case may be, to the applicant and the Borough Code Enforcement Officer; provided, however, that if a service entrance and/or metering are not involved in the work to be inspected, the issuance of a cut-in card to the utility will not be required.
C.ย 
When the electrical installation or construction is not approved by the underwriters inspector or inspection service, such inspector shall send a notice of noncompliance to the applicant and the Borough Code Enforcement Officer and, if required, to the local electric utility.
D.ย 
No electrical energy shall be introduced into a building which, previous to the installation or construction, had no electric energy until a cut-in card is issued to the local utility, excepting only as much electrical energy as may be used by contractors in furtherance of the construction work, electrical or otherwise, in such building.
The Borough Code Enforcement Officer shall enforce the provisions of this Electrical Code and shall have the power, when he is notified by the Middle Department of Fire Underwriters or another approved electrical inspection service or by other persons that certain electrical installations or construction is being done contrary to the requirements of this code, to cause such work to be stopped and to enforce compliance with the code and the further power, in the event of an existing electric wiring system found upon inspection to be unsafe or defective, to notify and order the owner of such premises to discontinue the use of such system until the defect(s) has been corrected, the system made to conform to the requirements of this Electrical Code, and the system approved by the electrical inspection agency.
Appeals and the procedure for appeals shall be as set forth in the Borough Building Code.
It shall be unlawful for any person to violate any provision of this code or to cause, permit or suffer any such violation to be committed or to violate any rule or regulation adopted by the Code Enforcement Officer pursuant to authority granted by this code. Any such person shall be deemed guilty of a violation of this article and shall, upon conviction thereof, be sentenced to pay a fine of not more than $300, and costs of prosecution, or, in default of payment of such fine and costs, to undergo imprisonment for not more than 30 days. It shall be the responsibility of the offender to abate the violation as expeditiously as possible, provided that each violation of any provision of this article, and each day the same is continued, shall be deemed a separate offense.
