The terms of office of Mayor and of all Village Trustees shall be four years.
Except for the general Village election of 2011, and beginning with the general Village election of 2012, the general Village elections shall be held biennially in the even-numbered years.
Upon this article becoming effective in an even year, the offices of Mayor and of all Trustees which terms have been herein extended shall be filled for terms of four years commencing at the beginning of the official year following the next Village election at which such offices are to be filled, except initially, the successor to the Mayor or a Trustee whose term of office expires in an odd-numbered year, at the general Village election preceding the expiration of such term of office, shall be elected for a single three-year term and their successors shall thereafter be elected for terms of four years.

This article is enacted in order to provide conformance with the term of the Village Justice of the Village of Baldwinsville with the general elections of the Village of Baldwinsville, which are to be held in even numbered years. Pursuant to Local Law No. 2 of 2010, and Village Law § 3-302, Subdivision 5a, the Village provided that beginning with the general Village election of 2012, general elections in the Village of Baldwinsville would be held biennially in even-numbered years. The terms of the Mayor and Trustees which expired in odd-numbered years were altered in order to provide for the election of the Mayor and Trustees in the even-numbered years of general Village elections. The Village Justice of the Village of Baldwinsville served a four-year term and was elected in 2011. Thereafter, elections solely for the Village Justice have taken place in odd-numbered years, 2015, 2019, and will take place in 2023. These elections have taken place notwithstanding Village Law § 3-302, Subdivision 7b, which provides that where a village has adopted a local law providing for biennial years, the term of not only the mayor and trustees elected in an odd year but also the village justice would be reduced to three years in order to comply with the biennial election. In order for the term of the Village Justice to coincide with the Village general election, and comply with the provisions of Village Law § 3-302, Subdivision 7b, this article will extend the term of office of the current Village Justice to a single five-year term commencing with the Village election in 2023, and the Village Justice will be elected in the general Village election in 2028 and for terms of four years thereafter.
Pursuant to the provisions of Local Law No. 2 of 2010, electing a biennial year for general elections of the Village of Baldwinsville, and the provisions of Village Law § 3-302, Subdivision 7b, the term of office of the successor to the Village Justice of the Village of Baldwinsville shall be a single five-year term beginning with the official year of the Village of Baldwinsville beginning in 2023 and the successor shall thereafter be elected for terms of four years beginning with the general Village election in 2028.
The invalidity of any provision of this article shall not affect the validity of any other provision of this article that can be given effect without such invalid provision.
This article shall take effect immediately upon filing in the Office of the Secretary of State.
