A certain document, three copies of which are on file in the office of the Secretary of the Borough of Colwyn, Delaware County, Pennsylvania, being marked and designated as the "BOCA Basic Plumbing Code/1981, Fifth Edition," as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Plumbing Code of the Borough of Colwyn, Delaware County, Pennsylvania, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of the BOCA Basic Plumbing Code/1981, Fifth Edition, are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with the additions, insertions and changes, if any, prescribed in § 111-4 of this chapter.
A. 
The administrative authority of this Plumbing Code shall be the Plumbing Inspector.
B. 
It shall be the duty of the Plumbing Inspector to enforce the provisions of said Plumbing Code and to make the inspections and tests required thereunder.
C. 
The Plumbing Inspector shall, after proper identification, have the right to enter any premises for the purpose of inspecting any plumbing system at such times as may be reasonably necessary to protect the public health.
D. 
The Plumbing Inspector shall be appointed by the Borough Council of the Borough of Colwyn.
A. 
Performance of work by or under registered plumber required. No individual, firm, partnership, corporation or other entity shall engage in the business of installing, repairing or altering plumbing in the Borough of Colwyn unless the plumbing work performed in the course of such business is done by a registered plumber or is done under the direct supervision of a registered plumber.
B. 
Registration and fee. The registration and fee for plumbers shall be as specified in Chapter 48, entitled "Contractor Registration." (See § 48-6, License fee.)

C. 
Insurance required. The insurance required for plumbers shall be as specified in Chapter 48, entitled "Contractor Registration." (See § 48-9B.)

D. 
Registration expiration. All registrations shall expire on December 31 of the year in which issued.
E. 
Use of name of registrant; change of address; exemption. No person who has been issued a plumber's registration shall allow his name or registration to be used by another person or a firm, partnership, corporation or other entity for the purpose of obtaining permits or for doing business or work under the registration. Every person registered shall notify the Plumbing Inspector of the address of his place of business, if any, and the name under which such business is carried on and shall give immediate notice to the Plumbing Inspector of any change in either. This section does not prohibit a registered plumber from obtaining a permit for his employer engaged in the business of installing, repairing or altering plumbing, for plumbing work to be done in whole or in part by other employees of said employer who are not registered plumbers, so long as such work is done under the direct supervision of a registered plumber.
F. 
Loss of registration. Failure to comply with the requirements of the Plumbing Code shall result in the loss of registration, in addition to other penalties prescribed in this chapter. The person so affected may appeal to the Borough Council.
The following additions, amendments, deletions and modifications to the BOCA Basic Plumbing Code/1981, Fifth Edition, are hereby made:
A. 
The words "Borough of Colwyn, Pennsylvania" shall be inserted in the second line of Section P-100.1 in place of the words "[name of jurisdiction]."
B. 
In Section P-104.1, Continuation, the adoption date of this chapter shall be inserted in the space marked "[date of adoption of this code]."
C. 
Section P-114.2 is amended to read as follows:
P-114.2 Fee schedule: The permit fees for all plumbing work shall be as adopted by resolution of the Borough Council and are on file in the Borough Administration Office.
D. 
Section P-117.4 is amended to read as follows:

P-117.4 Penalties: Any person who shall violate a provision of this code or who shall fail to comply with any of the requirements thereof or who shall install plumbing work in violation of an approved plan or directive of the Plumbing Official, or of a permit or certificate issued under the provisions of this code, shall be punishable by a fine of not more than $1,000 and costs of prosecution for each offense and, upon default in payment of the fine and costs, by imprisonment in the Delaware County Prison for not more than 30 days. Each day that a violation continues shall be deemed a separate offense.
E. 
Section P-118.2 is amended to read as follows:
P-118.2 Unlawful continuance: Any person who shall continue any plumbing work in or about the structure after having been served with a stop-work order, except such work as that person is directed to perform to remove a violation or unsafe conditions, shall be liable to a fine as provided in Section P-117.4 of this code.
F. 
In Section P-303.2, Public systems available, the words "150 feet" shall be inserted in the space marked "[number]."
G. 
In Section P-308.3, Freezing, the words "three feet six inches" shall be inserted in the spaces marked "[number]" in line 2, and the words "two feet six inches" shall be inserted in the spaces marked "[number]" in line 3.
H. 
A new Section P-112.8 is hereby added to said BOCA Code to read as follows:
P-112.8 Issuance of more than one permit: If the application for a permit also requires highway permits or additional permits for work covered by other ordinances of the Borough of Colwyn, all fees shall be paid and all permits shall be issued at one time.
Nothing in this chapter or in the Plumbing Code hereby adopted shall be construed to affect any suit or proceeding impending in any court or any rights acquitted or liability incurred or any cause or causes of action acquired or existing under any act or ordinance hereby repealed; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
