The Borough of Doylestown has heretofore enacted Ordinance No. 1981-9, as amended, which established the Doylestown Borough Police Pension Plan. In order to clarify the exact status and terms of the conditions of the Doylestown Borough Police Pension Plan and comply with the provisions of Act 600 of 1956, 53 P.S. § 761 et seq., in providing for administration, eligibility for benefits, source and allocation of funds, calculation of retirement benefits, return of participant contributions, vesting terms of retirement benefits, disability retirement, death benefit, and other matters associated with the establishment and continuation of the Police Pension Plan, including its compliance with the Pension Funding Equity Act of 2004, Pension Protection Act of 2006, and the final regulations issued under the Internal Revenue Code Section 415, effective as provided in the amendment and the collective bargaining agreement now in effect between the Borough of Doylestown and the Doylestown Borough Police Association, the Borough of Doylestown desires to establish and continue a Police Pension Plan for eligible participants employed by the Borough of Doylestown pursuant to and in accordance with the terms and conditions of the amendment and restatement of the Doylestown Borough Police Pension Plan (originally effective January 1, 1980, as amended, and restated effective January 1, 2008), which is attached hereto and made a part hereof as Attachment A.[1]

The amendment and restatement of the Doylestown Borough Police Pension Plan (originally effective January 1, 1980, as amended, and restated effective January 1, 2008), which is attached hereto and made a part hereof as Attachment A, is hereby established and adopted as the Police Pension Plan for eligible participants employed by the Borough of Doylestown, and the proper officers of the Borough of Doylestown are hereby authorized and directed to execute same on behalf of the Borough of Doylestown. Any previous ordinances or resolutions relating to the Doylestown Borough Police Pension Plan with an effective date prior to the adoption date of the amendment and restatement of the Doylestown Borough Police Pension Plan adopted hereunder are hereby repealed with respect to benefits accruing on or after the effective date of said amendment and restatement.

An amended and restated trust is hereby established, adopted and continued for the management of trust funds as provided for in the Doylestown Borough Police Pension Plan (as amended and restated effective January 1, 2008), which is Attachment A hereto, all pursuant to and in accordance with the provisions of the trust agreement which is attached hereto and made a part hereof as Attachment B,[1] and the proper officers of the Borough of Doylestown are hereby authorized and directed to execute said trust agreement on behalf of the Borough of Doylestown as trustee and as employer. Any previous ordinances or resolutions relating to said trust with an effective date prior to the adoption date of the amendment and restatement of the trust adopted hereunder are hereby repealed.

The Borough Manager of the Borough of Doylestown is hereby designated and appointed as the Chief Administrative Officer of the Police Pension Plan. The President of Borough Council is hereby appointed as the agent of employer with respect to the Police Pension Plan and the trust agreement.
