As used in this chapter, the following terms shall have the meanings indicated:
SKATEBOARD
A board made of either wood, plastic, aluminum or other similar material, or a combination thereof, with wheels attached and used for gliding and/or moving on any hard surface. Skateboard excludes "scooter" which is defined as a long footboard between end wheels controlled by an upright steering handle attached to the first wheel.
It shall be unlawful for any person to ride, propel, push or otherwise operate a skateboard or any similar vehicle on any public way, street, alley, sidewalk, parking lot or public property (except for public facilities authorized for such use and publicly sponsored events at which such use is authorized) within the corporate limits of the Town of Galena.

It shall be unlawful for the parent, guardian or other adult person having care and custody of a minor under 18 years of age, to permit such minor to ride, propel, push or otherwise operate a skateboard or any similar vehicle on any public way, street, alley, sidewalk, parking lot or public property (except for public facilities authorized for such use and publicly sponsored events at which such use is authorized) within the corporate limits of the Town of Galena.

Each violation of the provisions of §§ 140-2 and 140-3 shall constitute separate offenses.
Any person violating the provisions of this chapter shall be guilty of a municipal infraction and subject to a fine not to exceed $35 for the initial infraction and $70 for each repeat infraction. The skateboards may be confiscated when the offender is a juvenile and may be released after payment of the fine is received from the parent or guardian of the juvenile.
