portions of the streets of the City of Warren:

A.
On-street parking meter zones and metered parking facilities shall
be operative from 9:00 a.m. to 5:00 p.m. Monday through Friday excepting
the following holidays: New Year's Day, Martin Luther King, Jr. Day,
Presidents' Day, Good Friday, Memorial Day, Independence Day, Labor
Day, Columbus Day, Veterans' Day, Thanksgiving Day, the day following
Thanksgiving Day, Christmas Eve Day, Christmas Day, and New Year's
Eve Day.
B.
It shall be unlawful to park in any space within the on-street parking
meter zones between the hours of 3:00 a.m. and 6:00 a.m. all days.
In the parking meter zones established by § 440-39 and § 440-40 of this article, during the time when meters shall be operative, the maximum parking time shall be established by City ordinance and such time shall be displayed on the parking meter or multi-space parking kiosk and on on-street signage. It shall be a violation of this section to park in excess of the parking time limit.
The City Manager is hereby directed to provide for the installation,
maintenance, regulation, control, operation, and use of the parking
meters and/or kiosks provided for by this article. Expenditures for
the purchase, installation, and maintenance of parking meters and/or
kiosks may be paid from the Parking Revenue Fund.
B.
Single- and multi-space parking meters in on-street parking meter
zones shall be placed on the curb and shall be immediately adjacent
to the individual parking space to which such meter regulates. Each
single- or multi-space parking meter installed shall display the legal
parking time allowed as established by the City for such parking space
and, when operated, shall display the duration of time for which payment
was made and, upon the expiration of such period, shall display that
the paid parking time has expired.
C.
In areas where multi-space parking kiosks are utilized, such kiosk(s)
shall require the patron to enter the license plate of the vehicle
parked in the on-street parking meter zone or the metered parking
facility and shall provide for receipt of payment in United States
currency, credit card, debit card, or internet web-based application
for the selected time period.
A.
The Department of Public Works shall cause lines and/or markings
to be painted or placed upon the curb and/or upon the street adjacent
to each metered parking space for the purpose of designating the parking
space which such meter regulates.
B.
When such individual parking space in any parking meter zone is parallel,
perpendicular or diagonal to the adjacent curb, sidewalk or other
raised structure containing a single parking meter, any vehicle parked
in such individual parking space shall be parked so that the front
of such vehicle shall be nearest to the parking meter or the curb.
C.
The Department of Public Works shall cause lines and/or markings
to be painted or placed upon the surface and/or curbs of metered parking
facilities for the purpose of defining the space in which a vehicle
may be parked.
A.
The fees charged for the use of a metered parking space shall be
established by resolution of Council from time to time.
B.
Payment shall be made in United States currency via bills, coins,
credit card, debit card, or upon proper registration with the authorized
third-party vendor of the City, payment may be made via the vendor's
internet web-based application.
C.
A vehicle may be parked only in the metered zone in which payment
is made. Parking in a zone other than the zone in which payment was
made shall constitute a violation of this article.
D.
Validation program. A voluntary merchant validation program may be
established for on-street and off-street metered parking areas. Applications
for the program shall be made on a form provided by the City and shall
include information that is deemed necessary by the City Manager or
his designee to issue and control such validation program participation.
The fee for one hour of validation shall be set by resolution of City
Council. Validations shall be assigned in a manner established by
the City Manager or his designee.
E.
Whenever any vehicle is parked in any space adjacent to a single-
or multi-space parking meter at any time during the period of limited
parking, as herein prescribed, the operator of such vehicle shall,
upon entering such parking space, immediately deposit or cause to
be deposited proper payment in United States currency in an amount
as specified upon such single- or multi-space parking meter. Upon
the deposit of such payment and placing the single- or multi-space
parking meter in operation, such parking space may be lawfully occupied
for the time period for which payment was made.
F.
Whenever any vehicle is parked in any space within a metered parking
facility, the operator of such vehicle shall immediately proceed to
the nearest multi-space parking kiosk within the metered parking facility
and enter the license plate number of the parked vehicle and make
payment for the selected time period. Any vehicle for which the license
plate number has not been entered at a multi-space parking kiosk within
a metered parking facility will be in violation and may be charged
as if the vehicle was unpaid for the duration of the hours of operation.
G.
Meter permits for service type vehicles. All public utility vehicles
and other similar service vehicles while making temporary installation,
repair and maintenance calls for customers, not on a routine schedule,
may display on a sun visor on the driver's side, a card or sticker
exempting them from making daily payments under this section. The
owners or their agents may apply to the Chief of Police, who shall
issue said permits at his discretion for an annual fee in an amount
as established from time to time by resolution of City Council.
H.
Meter permits for construction, repair or similar work. A person
or company requiring use of a metered space for a full day or days
because of construction, repair or similar work at one location, on
a temporary basis, may apply to the Chief of Police for a daily permit
at a per day rate equal to full use of the meter for that day, and
display of said permit on the sun visor on the driver's side shall
exempt the vehicle from making multiple daily payments. The Chief
of Police shall have discretion in issuing such permits.
It shall be unlawful and a violation of this section for any
person to make any manner of payment for any single- or multi-space
parking meter or any multi-space parking kiosk for the purpose of
increasing or extending the parking time of any vehicle beyond the
total legal parking time in the space occupied by such vehicle, as
prescribed in this article.
It shall be unlawful and a violation of this section for any
person to permit a vehicle to remain in any parking space adjacent
to a single- or multi-space parking meter or in a multi-space parking
facility following expiration of the time period for which payment
was made. The continuation of the violation for a period of more than
two hours shall constitute a new and separate offense for each successive
two-hour period.
It shall be unlawful and a violation of this section for any
person to deface, tamper with, open or willfully break, destroy or
impair the operation of any parking meter or kiosk installed under
the provisions of this article. Unlawful tampering with any parking
facility or tool of collection or enforcement shall be considered
unlawful tampering with public property as set forth by City Ordinance
No. 1050 and amended by Ordinance 1491 of December 12, 1988. Nothing
herein shall apply to the servicing or opening of parking meters by
officers, employees and/or peace officers of the City, or personnel
contracted to make repairs under the direction of the City Manager
or his designee.
A.
The police officer or meter enforcement officer issuing a parking
ticket/citation shall place on or attach to the vehicle, where possible,
a notice to the owner thereof that such vehicle was parked in violation
of a provision of this article and such notice shall include:
(1)
The state, provincial or other license number of such vehicle;
(2)
The location and nature of the parking violation;
(3)
The time at which such vehicle was noted to be parked in violation
of the provisions of this article; and
(4)
Any other facts, a knowledge of which is necessary to a thorough
understanding of the circumstances attending such violation.
A.
Every owner shall, within five business days from when the notice
of ticket/citation was attached to the vehicle, pay to the City of
Warren, as a fine and in full satisfaction of the violation, the sum

B.
The failure of such owner to make such payment to the City of Warren
within the five-business-day period shall render such owner subject
to the penalties hereinafter provided for violation of the provisions
of this article.
C.
If such owner shall, in fact, make payment after the five-business-day
period but before 30 calendar days have elapsed from the date of the
violation or before the filing of a complaint with the Magisterial
District Justice on account of such violation, the following payments
shall be accepted in full satisfaction of violations of this article:
