It shall be unlawful to establish, maintain or operate a private
dump or landfill in the territorial boundaries of Carroll County,
Virginia, after October 31, 1988, pursuant to § 15.1-879,
Code of Virginia.[1]

A.
It shall be unlawful for any person or entity to transport for disposal
into the territorial boundaries of Carroll County, Virginia, any garbage,
trash or refuse which has been compacted and baled in such a manner
that the same cannot readily be examined and inspected by manual means
by County officials for the purpose of determining if such garbage,
trash and refuse contains hazardous substances.
B.
It shall be unlawful for any person or entity to transport for disposal
into the territorial boundaries of Carroll County, Virginia, any garbage,
trash or refuse without depositing an indemnification bond with the
Carroll County Board of Supervisors to secure the County against any
damages or pollution to its natural resources, including but not limited
to its water supplies, and to secure the County's citizens from
any damages or diminution in value of their property within the County
and to further secure and to be applied toward the necessary funds
as might be required for treatment, cleanup or other remedial measures
necessitated by an accidental or negligent discharge or seepage of
pollutants from the garbage, trash or refuse, said bond to be set
in an amount and manner to be determined by the Carroll County Board
of Supervisors upon application by such person or entity.
C.
It shall be unlawful for any person to collect, haul, transport or
convey garbage or trash within the boundaries of Carroll County, Virginia,
except from one's own residence to a County-approved landfill,
except for an approved franchised refuse collector and except for
the transporting of such refuse in adequately covered trucks to points
outside of the boundaries of Carroll County, Virginia.

Violation of this article and any other solid waste ordinance
previously adopted by Carroll County shall be punishable as a Class
1 misdemeanor. Each day that a person violates such article or ordinance
shall constitute a separate offense, and such violation shall additionally
be subject to injunctive relief in a state court of competent jurisdiction.
