When the Mayor of the City of Warren or, in his absence, the
Vice President of Council, the Manager, or the Assistant City Manager,
considers that a state of emergency exists, the Mayor shall issue
a proclamation, which shall be in writing and copies of which shall
be made available to all news media and to each member of Council,
declaring a state of emergency for a period not to exceed five days
unless extended by action of Council.

In said proclamation, the Mayor or, in his absence, the Vice
President of Council, the Manager or the Assistant Manager may prohibit
in any part of the City where such dangers to life and property exist:
A.
Any person being on any public streets or in the public parks or
other public places during hours declared to be a curfew.

The assembly or gathering of a group of people, in such numbers designated
in the proclamation, upon public streets, parks, or other public areas.
B.
The entry or departure of persons into or from any restricted area.

The sale, purchase, or dispensing of any commodities or goods designated
in the proclamation.
C.
The transportation, possession or use of gasoline, kerosene or other
combustible, flammable or explosive materials, except in connection
with the normal operation of motor vehicles or normal home or commercial
use.
D.
Any other such activities reasonably believed to cause a clear and
present danger to the preservation of life, health, property, or the
public peace.

The proclamation shall be specific in designated areas and hours
of restrictions as well as with respect to any of the other restrictions
contained in this chapter.

Any person violating such proclamation of emergency shall, upon
conviction thereof, be sentenced to pay a fine not exceeding $1,000
plus costs and, in default of payment thereof, shall be subject to
imprisonment for a term not to exceed 30 days. Each day that a violation
of this article continues shall constitute a separate offense.
