No person or person shall occupy any street, alley or public ground in the City of Warren with any stand for the sale of lunches, drinks, fruits, candy, toys or any other thing; nor shall any person or persons set up or maintain any shooting gallery, striking machine or other device whatsoever upon any street, alley or public ground in the City; nor shall any person or persons set up, establish or maintain any shooting gallery, striking machine or other device upon private property, where money is received or charged by the person owning or conducting the same, without first having obtained a license from the Manager to do so and paying a license fee in an amount to be established from time to time by resolution of City Council.

No person or persons shall be granted exclusive use of any street, alley or public ground in the City of Warren for the purpose of a special event, including the right to have exclusive control over the operation of stands or devices as described in § 349-1 hereof, without receiving the approval of Warren City Council. In addition to any fees, applications, conditions or restrictions imposed by the person or persons obtaining a special event license hereunder upon the operation of stands and devices, any and all persons operating stands or devices must also obtain the license from the City of Warren required under § 249-1 hereof. The person or persons conducting the special event shall be responsible for submitting all required applications and fees for the required City license. The City of Warren shall not issue any licenses for operation of stands or devices within the area covered by the special event license other than those applied for by the person or persons conducting the special event.

No gambling device shall be licensed under this article and any license granted by the Manager and the license fee shall be forfeited.

All applications for licenses required under this article must be filed with the City at least five business days prior to the date or dates for which the license is requested.

Any person who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine not exceeding $600 plus costs and, in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days. Each day that a violation of this article continues shall constitute a separate offense.
