Any person desiring to conduct a transient retail business in the City of Warren for the sale of any goods, wares or merchandise whatsoever, and who leases, occupies a store, shop, building or structure for the exhibition and sale of such goods, wares or merchandise, shall first make application for a transient retail license to the City Manager; provided, however, that nothing in this section shall apply to farmers selling their own produce; or to any sale of goods, wares or merchandise donated by the owners thereof, the proceeds of which are to be applied to any charitable or philanthropic purposes; or to the sale of goods, wares or merchandise at times and in areas designated by the City, such as "farmers' market" or "community market"; or to the sale of household goods by the owners of such goods on their premises and commonly known as "garage sale," and not more than one day in any one year.

After the approval of the application by the Manager, the applicant shall pay a fee to be established from time to time by resolution of City Council for a transient retail license. Said license shall be in effect for a period of 15 days from the date of receipt of payment of the fee and the issuance of the license.

The license may be renewed by the Manager upon request of the applicant and upon payment of the license fee provided in § 349-7 of this article.

Nothing herein contained shall be construed to relieve any person, partnership or corporation from the duty of taking out a license or from the payment of any license tax imposed or authorized by any other ordinance of this City or statute of the Commonwealth of Pennsylvania.

Any person who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine not exceeding $600 plus costs and, in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days. Each day that a violation of this article continues shall constitute a separate offense.
