A.
It shall be unlawful for any person to do any act forbidden
or fail to perform any act required by this chapter.
B.
The parent of any child and the guardian of any ward shall not authorize
or knowingly permit any such child or ward to violate any of the provisions
of this chapter.
C.
These regulations applicable to pedalcycles shall apply whenever
a pedalcycle is operated upon any street or upon any public path set
aside for the exclusive use of pedalcycles, subject to the exceptions
stated herein.
As used in this chapter, the following terms shall have the
meanings indicated:
A vehicle propelled solely by human-powered pedals.
No person who resides within this City shall ride or propel
a pedalcycle on any street or upon any public path set aside for the
exclusive use of pedalcycles unless such pedalcycle has been licensed
and a license decal is attached thereto as provided herein.
A.
Application for a pedalcycle license and license decal shall be made
upon a form provided by the City and shall be made to the Police Department.
A license fee, the amount to be established by Council by resolution,
shall be paid to the City for each license issued.
B.
Licenses issued will be valid for the duration of time that the applicant
owns the pedalcycle and shall not have an expiration date.
C.
The Police Department shall retain the appropriate records relative
to the issuance of the license, to include, but not to be limited
to, the name, address and telephone number of the registered owner,
the pedalcycle description, including the manufacturer's model,
serial number, color, and wheel and/or frame size, if available.
A.
The Police Department upon the issuing of a pedalcycle license shall
also issue a license decal bearing the license number assigned to
the pedalcycle and the name of the City.
B.
The license decal shall be firmly attached to the frame of the pedalcycle
for which it was issued in such a position to be clearly visible.
C.
No person shall remove a license decal from a pedalcycle for which
issued except upon a transfer of ownership or in the event the pedalcycle
is dismantled and no longer operated upon any street in this City.
D.
A new decal shall be issued to the pedalcycle owner should the decal
be defaced, removed or otherwise necessitate replacement at no charge.
Upon the sale or other transfer of ownership of a pedalcycle,
the registered owner shall notify the Police Department of the change
of ownership.
Every person riding a pedalcycle upon a roadway shall be subject
to the provisions of the traffic ordinances of this City applicable
to the driver of a vehicle except as to special regulations in this
chapter and except as to those provisions of the ordinances which
by their nature can have no application.
No person operating a pedalcycle shall not ride other than upon
or astride the permanent and regular seat attached thereto, nor carry
any other person upon such pedalcycle other than upon a firmly attached
regular seat thereon, nor shall any person ride upon a pedalcycle
other than as above authorized.
No person shall operate a pedalcycle at a speed greater than
is reasonable and prudent under the conditions then existing.
The operator of a pedalcycle emerging from an alley, driveway
or building shall, upon approaching a sidewalk or the sidewalk area
extending across any alleyway, yield the right-of-way to all pedestrians
approaching on said sidewalk or sidewalk area and, upon entering the
roadway, shall yield the right-of-way to all vehicles approaching
on said roadway.
No person shall park a pedalcycle upon a street other than upon
the roadway against the curb or upon the sidewalk in a rack to support
the pedalcycle or against a building or at the curb in such manner
as to afford the least obstruction to pedestrian traffic.
Every person convicted of a violation of any provision of this
chapter shall be punished by a fine of not more than $5 or by removal
and detention of the license decal from such person's pedalcycle
for a period not to exceed 30 days or by impounding of such person's
pedalcycle for a period not to exceed 30 days, or by any combination
thereof.
