No person shall perform electrical inspections unless licensed
as an Electrical Inspector by the Westchester County Electrical Licensing
Board.
As used in this article, the term "Electrical Inspector" shall
mean any person who now or hereafter inspects electrical components,
equipment and systems used in buildings and structures to determine
the compliance of such electrical components, equipment and systems
with the applicable provisions of the New York State Uniform Fire
Prevention and Building Code promulgated pursuant to Article 18 of
the Executive Law. All Electrical Inspectors licensed by the Electrical
Licensing Board, as defined in this chapter, are hereby authorized
and deputized as agents of the Town of New Castle to make inspections
and reinspections of all electrical installations heretofore and hereafter
described, only for which they are licensed, and to approve or disapprove
the same. In no event, however, will the cost or expense of such inspections
and reinspections be a charge against the Town of New Castle.
A.
It shall be the duty of the Electrical Inspector to report, in writing,
to the Building Inspector, whose duty it shall be to enforce all provisions
of this chapter, all violations or deviations from or omissions of
the electrical provisions of the New York State Uniform Fire Prevention
and Building Code, the State Energy Conservation Construction Code
and this chapter and of all local laws and ordinances as referred
to in this chapter, insofar as any of the same apply to electrical
wiring. The Electrical Inspector shall make inspections and reinspections
of electrical installations in and on properties in the Town of New
Castle upon the written request of an authorized official of the Town
of New Castle or as herein provided. The Electrical Inspector is authorized
to make inspections of electrical wiring, installations, devices,
appliances and equipment in or on properties within the Town of New
Castle where he or she deems it necessary for the protection of life
and property. In the event of an emergency, it is the duty of the
Electrical Inspector to make electrical inspections upon the oral
request of an official or officer of the Town of New Castle.
B.
It shall be the duty of the Electrical Inspector to furnish written
reports to the proper officials of the Town of New Castle and the
owners and/or lessees of property where defective electrical installations
and equipment are found upon inspection. He or she shall authorize
the issuing of a certificate of compliance when electrical installations
and equipment are in conformity with the New York State Uniform Fire
Prevention and Building Code, the State Energy Conservation Construction
Code and this chapter. He or she shall direct that a copy of tl1e
certificate of compliance be sent to the Town of New Castle to the
attention of the Building Inspector.
It shall be a violation of this chapter for any person, firm
or corporation to install or cause to be installed or to alter electrical
wiring for light, heat or power in or on properties in the Town of
New Castle until an application for inspection has been filed with
an Electrical Inspector in accordance with this chapter. It shall
be a violation of this chapter for a person, firm or corporation to
connect or cause to be connected electrical wiring in or on properties
for light, heat or power to any source of electrical energy supply
prior to the issuance of a temporary certificate or a certificate
of compliance by an Electrical Inspector.
A.
Any person desiring to be an inspector must register with the Building
Department of the Town of New Castle to perform electrical inspections
by providing the following information and documentation to the Town
Engineer or his or her designee for review and determination as to
its acceptability:
(1)
A copy of a valid and subsisting certificate from the International
Association of Electrical Inspectors or the International Codes Council
to perform inspections of one and two-family homes and/or commercial
establishments. The original certificate must be displayed to the
Town Engineer or his or her designee.
(2)
Such person's address and telephone contact number and e-mail address,
if available.
(3)
Proof of insurance showing workers' compensation, general liability,
and other coverage naming the Town of New Castle as an insured and
agreement to defend and indemnify the Town of New Castle in each case
in such scope and amount as the Town Board shall set by resolution.
(4)
If such person is a firm, corporation or other entity, the subject
certificate must be provided for each employee for whom authorization
is sought to perform electrical inspections.
(5)
A fee schedule for charges to be incurred by a property owner for
an inspection.
B.
Based upon the submission above, the Town Engineer or ·his
or her designee shall determine the types of buildings which an inspector
shall be authorized to inspect, and maintain a list in the Town's
Building Department specifying same.
C.
The authority granted to an inspector under this chapter shall expire on December 31 of every year, but shall be subject to reauthorization within 30 days prior to such expiration upon confirmation or resubmission of the certification, insurance, indemnification agreement, and information required under § 48-34A.
D.
The authority granted to any inspector in accordance with this chapter
is subject to revocation upon the Town Engineer's receipt of evidence
that the subject inspector has violated this chapter. Any disputes
as to the basis of revocation of such authority shall be referred
to the Town Board, whose determination shall be binding.
