The Council of the Borough of Ligonier (hereinafter called "Borough") and the Board of Supervisors of the Township of Ligonier (hereinafter called "Township") have agreed to enter into an Intergovernmental Cooperation Agreement for each municipality's performance of certain duties and the exercise of certain governmental powers and functions on behalf of the other under the provisions of 53 Pa. C.S.A. § 2301 et. seq.
The term of the Intergovernmental Cooperation Agreement shall be perpetual with the condition that either the Borough or the Township may terminate said agreement upon six months' written notice to the other municipality.
The Borough and the Township agree to cooperate with each other as follows:
A. 
The Borough authorizes the Township and the Township authorizes the Borough, upon request, to perform the following acts on its behalf:
(1) 
To enter into the jurisdiction of the requesting municipality along with any employees, agents, professionals and equipment necessary for performance of requested governmental services;
(2) 
To perform any governmental, recreation or public works services that shall be requested by either municipality;
(3) 
To complete all tasks required to assure proper delivery, performance and completion of any governmental service requested by either municipality; and
(4) 
To retain responsibility for the management, control and direction of its employees, agents and professionals to perform its duties and services under this agreement.
There is no financing involved with the Intermunicipal Cooperation Agreement.
There is no additional organizational structure necessary to implement the agreement.
There is no real or personal property being acquired, managed, licensed or disposed of by the Intermunicipal Agreement.
There is no new entity being created by the Intermunicipal Agreement.
The Intermunicipal Cooperation Agreement shall become effective when adopted by ordinance by both the Borough and the Township.
