The speed limit for both directions of traffic
along the streets or parts thereof described below is hereby established
at the rate of speed indicated in said schedule. It shall be unlawful
for any person to drive a vehicle at a higher speed than the maximum
prescribed for that street or part of a street.[1]

EMERGENCY VEHICLE
LOCAL DELIVERY VEHICLE
MOTOR VEHICLE
SCHOOL BUS
Definitions. The following words when used in this section shall
have the meaning given to them in this Subsection, except in those
instances where the context clearly indicates a different meaning.
A fire department vehicle, police vehicle, sheriff vehicle,
ambulance, advanced life support squad vehicle, basic life support
squad vehicle, blood delivery vehicle, human organ delivery vehicle,
hazardous material response vehicle, armed forces emergency vehicle,
one vehicle of a coroner, chief county medical examiner, chief deputy
coroner, deputy chief county medical examiner used for answering emergency
calls, a vehicle owned by or leased to a regional emergency medical
services council that is used as authorized by the PA Department of
Health to respond to an actual or potential disaster, mass casualty
situation or substantial threat to public health, fire or police chief
or assistant chief or ambulance corps commander or assistant commander
or a river rescue commander, county and local emergency management
coordinator, fire marshal, rescue chief and assistant used for answering
emergency calls or other vehicle designated by the State Police under
Section 6106 of the Vehicle Code[1] (relating to designation of emergency vehicles by Pennsylvania
State Police).
Any motor vehicle which is utilized for the provision of
consumer services, including utility and refuse services or repairs,
to properties located upon Township roads.
A vehicle which is self-propelled except an electric personal
assistive mobility device or a vehicle which is propelled solely by
human power.
A motor vehicle designed for carrying more than 11 passengers,
including the driver, and used for the transportation of preprimary,
primary or secondary school students to or from public, private or
parochial schools or events related to such schools or school-related
activities.

The Supervisors
have hereby determined that certain roads under the jurisdiction of
the Township may be damaged or destroyed unless the permissible weight
limit of motor vehicles or combinations is limited. Accordingly, no
motor vehicle having a gross weight in excess of 20,000 pounds shall
be operated upon the following sections of roads and highways owned
and/or maintained by Girard Township and located within the jurisdiction
of Girard Township from February 15 through and including May 15:

C.Â
The Supervisors shall cause the restricted section of roads and highways
to be posted for the applicable limitations, said posting to be in
accordance with the requirements of the Pennsylvania Motor Vehicle
Code[2] and other applicable laws and regulations of the Commonwealth
of Pennsylvania.

D.Â
Emergency vehicles, local delivery vehicles and school buses, as defined herein, shall be exempt from the restrictions imposed under Subsection B above. However, if the Board of Supervisors or Roadmaster determine that any emergency vehicle, local delivery vehicle or school bus is likely to damage a road, the Supervisors will so notify the registrants of the motor vehicle(s) and will also notify the PA State Police. After two business days following delivery of the notice, or after five days following mailing of the notice, such vehicle or vehicles shall not exceed the weight limits except in accordance with Subsection E hereof.
E.Â
Permits.
(1)Â
The Supervisors or Roadmaster may issue permits for movement of vehicles
in excess of the restrictions established hereunder. Applications
for a permit shall be made, in writing, to the Township and shall
contain such information as the Township shall require pertaining
to the applicant, area of operations and municipal roads to be traveled
and:
(a)Â
The application shall also include a description of all motor
vehicles and equipment to be used in the transporting of all materials.
Such list shall include among other things each vehicle's registration
number, plate number, make, model and color.
(b)Â
The application shall also include a copy of all valid local,
state and/or federal permits, contracts and agreements which are required
to be obtained by the operator or owner of the motor vehicle.
(c)Â
At the discretion of the Board of Supervisors or Roadmaster,
the application may be required to be accompanied by a signed excess
maintenance agreement which obligates the permittee to make repairs
of damages caused to the roads by the permittee's activities.
(d)Â
The permittee may be required to submit such bond or other collateral
acceptable to and in the favor of the Township as the Township may
require to ensure faithful compliance with the provisions of this
section.
(2)Â
The requirements of this Subsection E shall be deemed to run in the favor of the Township, and the failure of the Township to insist upon compliance with each of the requirements set forth herein shall not render this section invalid or otherwise preclude the Township from seeking enforcement of the other provisions of this section.
F.Â
The permit required under Subsection E shall be issued with respect to any road listed under Subsection B if there is no reasonable alternate route available. "Reasonable alternative route" shall mean a route meeting the criteria set forth in the regulations of the PA Department of Transportation (or any successor agency) relating to traffic and engineering studies.
G.Â
There is hereby established an application fee of $50 for the above-referenced
excess maintenance agreement which application fee may be increased
or decreased by subsequent resolution of the Township.
H.Â
Violations and penalties.
(1)Â
Upon conviction by a Magisterial District Judge, any person violating
this section shall pay a fine in an amount consistent with the applicable
fine set forth in the Pennsylvania Motor Vehicle Code at the time
of the violation.
(2)Â
As of the enactment of this section, the applicable section of the
Pennsylvania Motor Vehicle Code is 75 Pa.C.S.A. § 4902(g),
which provides as follows:

Any person operating a vehicle or combination upon a highway
or bridge in violation of a prohibition or restriction imposed under
subsection (a) is guilty of a summary offense and shall, upon conviction,
be sentenced to pay a fine of Seventy Five ($75.00) Dollars, except
that any person convicted of operating a vehicle with a gross weight
in excess of the posted weight shall, upon conviction, be sentenced
to pay a fine of One Hundred Fifty ($150.00) Dollars, plus One Hundred
Fifty ($150.00) Dollars for each 500 pounds, or part thereof, in excess
of 3,000 pounds over the maximum allowable weight.

Any person who shall operate a vehicle in violation of the traffic
regulations established in this article shall be punishable as set
forth in the appropriate sections of the Pennsylvania Vehicle Code
(75 Pa.C.S.A. § 101 et seq.).
