No person, group of persons, association, partnership or corporation or any combination thereof who owns, manages, conducts or operates a dwelling unit shall rent, lease, let, sublet or permit the same to be occupied or re-rented by another without first securing from the public officer of the Borough a certificate of occupancy for said dwelling unit.

No certificate of occupancy shall be issued for a dwelling unit unless the condition of same complies with Chapter 240, Property Maintenance Code, and with all of the ordinances of the Borough now in existence or hereafter enacted pertaining to building, plumbing, electrical, zoning, health, safety, fire and minimum housing standards and all departmental regulations established pursuant to said ordinances or laws. Furthermore, no certificate of occupancy shall be issued unless all electrical and gas appliances shall be clean and in proper working order, all rugs shampooed, all glass surfaces washed and all walls, floors and ceramic surfaces cleaned and sanitary. Pursuant to and in accordance with N.J.S.A. 40:52-1.2, no certificate of occupancy will be issued to a dwelling unit owner whereby the dwelling unit owner has failed to pay the taxes due on the property for at least three consecutive quarters. Upon payment of the delinquent taxes or assessments, the certificate of occupancy will be issued.
A "dwelling unit" is a room or group of rooms which form a single unit to be occupied by one or more persons for all or any combination of the following uses: living, sleeping, cooking and eating.

The public officer, for the purposes of this article, shall be the Municipal Code Enforcement Officer.
Thirty days after the effective date of this article, the party responsible for the dwelling units shall provide to the public officer a list, by unit, containing the names and addresses of all tenants. Further, by the first day of each succeeding month, a list of the changes in occupancies shall be provided to said public officer.
All applications for the issuance of a certificate of occupancy shall be accompanied by a fee as provided in Chapter 150, Fees, Article I, Fee Schedule, § 150-17, made payable to the Borough of Lindenwold.

Any individual person, group of persons, association, partnership or corporation or any combination thereof who leases or rents a dwelling unit without a certificate of occupancy being issued by the public officer shall be subject to a fine of $100 for each day each dwelling unit is occupied without a certificate of occupancy.
