Occupancy certificates shall hereafter be required for human habitation every time a residential dwelling unit changes ownership.
The occupancy certificate required herein does not repeal or amend requirements for other occupancy certificates heretofore provided for by ordinance of this Borough or statutes of the State of New Jersey.
A. 
Application for an occupancy certificate for change in ownership shall be made to the Code Enforcement Office of this Borough on a form provided by said office.
B. 
The Code Enforcement Office shall thereupon cause an inspection to be made of the subject dwelling unit to determine if such unit is fit for human habitation and in compliance with all applicable Borough ordinances and regulations of the International Code Council and the International Property Maintenance Code, 2012, or as updated.

The owner of each dwelling unit subject to this article is hereby charged with the responsibility for making written application to the Code Enforcement Office for an occupancy certificate.
A. 
The application to the Code Enforcement Office shall be accompanied by a nonrefundable fee as provided in Chapter 150, Fees, Article I, Fee Schedule, § 150-17. The inspection must be scheduled within 60 days of the date of the application.

B. 
The Code Enforcement Officer or his representative shall, within 10 working days of the receipt of a fully completed application for occupancy certificate and the accompanying fee pursuant to this article, make such inspections as are required hereinabove and, upon determining that the requirements have been complied with, issue an occupancy certificate.
C. 
If, upon the inspection or inspections aforesaid, the Code Enforcement Officer or his representative finds the subject dwelling unit not in compliance, said Officer or his representative shall thereupon, and within the said 10 working days, notify the applicant, in writing, of such noncompliance, specifically setting forth the violation or violations which require correction.
D. 
Upon correction of the violations, the applicant shall notify the Code Enforcement Office, in writing, and shall submit a reinspection fee as provided in Chapter 150, Fees, Article I, Fee Schedule, § 150-17, with such notification, whereupon the Code Enforcement Officer or his representative shall reinspect the subject dwelling upon receipt of such notification and reinspection fee. This procedure shall be followed until all violations have been corrected, at which time an occupancy certificate shall be issued.

E. 
The Code Enforcement Officer shall furnish copies of all regulations referred to herein to any person requiring the same for a reasonable fee commensurate with the costs of reproducing such regulations.
Any person charged with the responsibility for obtaining an occupancy certificate pursuant to this article who violates the provisions hereof shall be subject, upon conviction thereof, to penalties provided for in § 240-37.
