This article is for the purpose of regulating the sale of alcoholic beverages in the Borough of Lindenwold, County of Camden, and State of New Jersey, in accordance with the provisions of an act of the Legislature entitled "An Act Concerning Alcoholic Beverages," Chapter 436 of the Laws of 1933,[2] as amended and supplemented, and in accordance with the rules and regulations promulgated or to be promulgated by the Director of the Division of Alcoholic Beverage Control applicable hereto, and in accordance with the rules and regulations existing herein or hereafter adopted by competent municipal authority not inconsistent with said Act or said rules and regulations of said State Director.

As used in this article, the following terms shall have the meanings indicated:
PERSON
Any natural person or association of natural persons, association, trust, company, partnership, corporation, organization, or the manager, agent, servant, officer or employee of any of them.
SALE
Every delivery of any alcoholic beverage otherwise than by purely gratuitous title or the solicitation or acceptance of an order for any alcoholic beverage, and including exchange, barter, traffic in, keeping and exposing for sale, serving with meals, delivering for value, peddling, possessing with intent to sell and the gratuitous delivery or gift of any alcoholic beverage by any licensee.
It shall be unlawful for any person or persons to operate, use or maintain any store, dwelling or other buildings for the sale or exposure for sale of any of the beverages authorized by the above-mentioned Act of the Legislature, or to conduct the business of or otherwise engage in selling or distributing such beverages, within the corporate limits of the Borough of Lindenwold, without first obtaining a license therefor as herein provided.
A. 
Any persons who may desire a Class C license, that is, either a plenary retail consumption license or a plenary retail distribution license as provided in said Act, shall first make application therefor on a blank form which shall be furnished by the Borough Clerk. Said application, when fully completed and accompanied by cash or a certified check for 100% of the requisite license fee, shall be filed with the Borough Clerk, who shall present the same to Borough Council at the next meeting thereof for the issuance of a license subject to the rules and regulations and in accordance with the provisions of the said Act if said applicant shall be duly qualified for and entitled to a license thereunder. Any such license shall not be valid unless sealed with the corporate seal of the Borough, attested by the Borough Clerk, and the license fee paid in full.
B. 
Any person who may desire a club license or a renewal of a club license shall, in addition to any other requirements imposed by law, deliver to the Clerk a list of members entitled to use the applicant's facilities. The list may be amended by the applicant from time to time to reflect new members. The applicant shall also supply to the Clerk a copy of the club's bylaws setting forth the requirements and qualifications of members and guests.

Any such license shall be subject to the provisions of said Act and of this article and to the police regulations and ordinances of this Borough.

A. 
No licensee hereunder shall operate, keep or permit to be kept open for the sale or distribution of beverages any place so licensed between the hours of 3:00 a.m. and 6:00 a.m. on any weekday, or between the hours of 3:00 a.m. and 6:00 a.m. on Sundays. All lights outside of the building must be extinguished and music discontinued at 2:30 a.m. and the premises cleared of all patrons by 3:30 a.m.
B. 
Notwithstanding the foregoing, no establishment operating under a club license and located in an R-1 Zone shall operate, keep or permit to be kept open for the sale or distribution of beverages between the hours of 12:00 a.m. and 9:00 a.m. on Sunday through Thursday and between the hours of 2:00 a.m. and 9:00 a.m. on Friday and Saturday. The premises of any establishment operating under a club license in an R-1 Zone shall be cleared of patrons, members and/or guests by 12:30 a.m. on Sunday through Thursday and by 2:30 a.m. on Friday and Saturday.

Notwithstanding the provision of any Borough ordinance limiting the hours for the sale of alcoholic beverages in the Borough of Lindenwold, any licensee may also sell such beverages between the hours of 3:00 a.m. and 5:00 a.m. on January 1, commonly known as "New Year's Day."

No licensed establishment operating in a residential zone shall permit any outdoor activities between the hours of 10:00 p.m. and 8:00 a.m. except for the coming and going of patrons.
Every license shall be exposed to the public view in a conspicuous place on the premises licensed, and any failure to do so shall constitute presumptive evidence that the place where alcoholic beverages are being sold is unlicensed.

The annual fees for alcoholic beverage licenses in the Borough of Lindenwold are provided in Chapter 150, Fees, Article I, Fee Schedule, § 150-11.

All license fees shall be paid in cash or certified check to the order of the Borough of Lindenwold, New Jersey, and shall be paid into the Borough treasury.
Any person who shall violate any of the provisions of this article shall, upon conviction thereof, be subject to the penalties as set forth in Chapter 1, § 1-1, of this Code.
