The purpose of this article is to provide for the licensing and identification of dogs in the Town of Kendall by establishing local license types and new fee structures as a result of the State of New York's dissolved interest in dog licensing, except for administering the animal population control fees.
This article is enacted pursuant to the provisions of Article 7 of the Agriculture and Markets Law and shall apply in all areas of the Town of Kendall.
This article shall be referred to as the "Dog Licensing Law of the Town of Kendall."
As used in this article, the following words shall have the following respective meanings:
DOG
Male or female, licensed or unlicensed, members of the species Canis familiaris.
HARBOR
To provide food or shelter to any dog.
OWNER
Any person who owns, keeps, or harbors or has care of a dog. Dogs owned by minors shall be deemed to be in the custody and control of the minor's parent, guardian or other head of household with which such minor resides.
A. 
All dogs, aged four months and older, harbored in the Town of Kendall, shall be licensed in the municipality pursuant to the fees set forth as follows; as may be amended by the Kendall Town Board from time to time:
(1) 
Local license fees:
(a) 
Spayed or neutered dogs: $6 per dog.
(b) 
Unspayed or unneutered dogs: $12 per dog.
(c) 
Replacement tags: $2 per tag.
(2) 
New York State surcharges for Animal Population Control Fund:
(a) 
Spayed or neutered dogs: $1 per dog.
(b) 
Unspayed or unneutered dogs: $3 per dog.
B. 
All such licensing fees set by the Town of Kendall shall be subject to change through resolution of the Kendall Town Board.
A. 
Guide dogs, therapy dogs, and other service dogs harbored within the Town of Kendall shall be exempt from all local licensing fees and New York State surcharges.
B. 
Any dog harbored within the Town of Kendall which is licensed by the City of New York, or by a jurisdiction outside of the State of New York, shall for a period of 30 days be exempt from the licensing and identification provisions of this article.
A. 
Pursuant to Article 7 of the NYS Agriculture and Markets Law, the Town Clerk shall forward all surcharges collected for the Animal Population Control Fund to the address specified by the State of New York.
B. 
The Town of Kendall shall forward monies as agreed by contract to the entity providing Animal Control Shelter Services.
This article shall take effect January 1, 2011, upon due filing with the Secretary of State of the State of New York.[1]
