The following words, terms, and phrases, when used in this article,
shall have the meanings ascribed to them in this section, except where
the context clearly indicates a different meaning:
As stated in § 167.10(1), Wis. Stats.
Except as provided in § 167.10(2) and (4), Wis. Stats.,
no person shall sell, or possess with the intent to sell, fireworks.
Except as provided in § 167.10(3), Wis. Stats., no person shall possess or use fireworks without a user's permit issued pursuant to § 275-18.

A permit may not be issued to a minor.
B.
Fireworks permit issuance. As provided in § 167.10(3),
Wis. Stats., fireworks user's permits may be issued by the Village
President with the recommendation of the Richfield Volunteer Fire
Company, or other Village official designated by the Village President,
at least one week prior to the authorized use. The Fire Company or
Village official will examine the following in order to ensure the
safety of the applicant and any neighboring persons and/or property:
(1)
Size of the property.
(2)
Location of neighboring structures.
(3)
Location of any neighboring property susceptible to fire or burn
damage.
(4)
Condition of surrounding vegetation such as dry grass, trees, shrubs,
etc.
(5)
Location of any combustible materials.
(6)
Any other conditions or circumstances related to the safety or well-being
of surrounding persons and property.
C.
Permit fee. The fee for the permit shall be in an amount deemed necessary
by the Village Board, as set in the fee schedule, and must be submitted
at the time of application.
D.
Liability insurance. The official issuing the permit shall require
a certificate of liability insurance, or similar proof of coverage,
in an amount not less than $1,000,000 or an amount larger deemed necessary.
Said liability insurance shall name the Village of Richfield as an
additional insured. A copy of the permit and proof of insurance shall
be filed with the Clerk, and copies of the permit shall be given to
the Fire Chief and Washington County Sheriff’s Deputy or Village
law enforcement officer at least two days before the authorized use.[2]
E.
Appeal. In the event of a denied request by the Village President
upon recommendation of the Fire Company or other designated Village
official, the applicant has the option to appeal the decision to the
Village Board at a regularly scheduled meeting.
No person may use fireworks or devices listed in § 167.10(1)(e)
to (g) and (i) to (n), Wis. Stats., including but not limited to caps,
toy snakes, model rocket engines, sparklers, or cone fountains, at
a fireworks display for which a permit has been issued if the display
is open to the general public.
