Straban Township hereby elects to administer and enforce the provisions of the Pennsylvania Construction Code Act (Act 45 of 1999; 35 P.S. § 7210.101 et seq., as amended) and the regulations promulgated thereunder, as amended from time to time ("the Act").
The Uniform Construction Code, contained in 34 Pa. Code, Chapters 401 to 405, as amended from time to time, and in all other relevant regulations ("the code") is hereby adopted and incorporated herein by reference as the building code for Straban Township.
Administration and enforcement of the code within Straban Township shall be undertaken in any of the following ways, as determined from time to time by the Board of Supervisors by resolution:
A. 
By the retention of one or more duly qualified construction code officials or third party agencies to act on behalf of the Township;
B. 
By the designation of one or more duly qualified employees to serve as the code official to act on behalf of the Township; or
C. 
By agreement with one or more other municipalities for the administration and enforcement of the Act and the code, or for the joint administration and enforcement of the Act and the code, through an intermunicipal cooperation agreement.
A Board of Appeals, or inclusion in a jointly operated Board of Appeals, shall be established by resolution of the Board of Supervisors of the Township. The Board of Appeals shall be, or have been, constituted in conformity with the relevant provisions of the Act and the code.
Nothing herein shall affect any other ordinance or regulation addressing building and/or development which is not inconsistent with the Act or the code. In the case of conflict or inconsistency between the code and any other ordinance or regulation of the Township affecting building and/or development, the more restrictive provision shall apply.
The Board of Supervisors shall establish a schedule of fees by resolution for the administration and enforcement of the Act and the code. Such fees may be revised from time to time as the Board of Supervisors shall deem appropriate.
This chapter shall take effect 180 days from the date the official notice was provided to the Department of Labor and Industry. Thus, the earliest effective date of this chapter is September 7, 2012.
