A.
This chapter shall be known and may be cited as the "Park Ordinance."

Whenever used in this chapter, the following terms shall have the
meanings indicated:
Includes play spaces, play areas, tot-lots, designated open
spaces, and outdoor recreational facilities which are:
Owned by the Borough of Clifton Heights; or
Owned by the school district of the Township of Upper Darby
when the same are situate in the Borough of Clifton Heights and leased
by the Borough of Clifton Heights. Property which is leased from the
school district of the Township of Upper Darby shall only be included
within the terms of this chapter when the same is being used as a
park or recreational area as set forth herein.
No person shall be allowed in a park except between the hours of 7:00 a.m. Eastern standard time and sundown, unless a permit has been obtained as provided in § 232-4. Additionally, if a facility is equipped with night lighting, it shall remain open only according to the terms of the issued permit.
Use of all parks shall be regulated by the Clifton Heights Recreational
Board, either by the issuance of rules and regulations or the issuance
of permits. Except as otherwise stated herein, in the absence of the
issuance of rules, regulations or a permit, any lawful use of a park
is permitted.
Permits for the use of parks shall be issued by the Board upon
application by an interested party. No charge shall be made for such
permits. No permit shall be issued, however, unless an application
therefor is made to the Board in writing at least 48 hours before
the applicant intends to use a park. Any person to whom a permit is
issued shall be liable for any loss, damage, or injury sustained by
any person or persons by reason of the negligence or fault of the
applicant, his servants, agents, guests, or employees.
No pets are permitted in any park at any time.
The Police Department of the Borough shall have the power to
enforce this chapter and shall exercise general supervision over persons
and properties in all parks.
Any person violating any of the provisions of this chapter shall
be liable for a penalty of not more than $300 for each and every offense,
to be collectible before any Magisterial District Judge as like penalties
are now by law collectible.
