As used in this chapter, the following terms shall have the
meanings indicated:
PERMIT
A written permit issued by the Commission.
PERSON
Any individual, firm, partnership, association, corporation,
company or organization of any kind.
PUBLIC AREA
Any public street, alley, park, easement, right-of-way or
other area under control of the Borough or commonwealth.
PUBLIC SHADE TREE
All trees, living or dead, occupying or designated by the
Shade Tree Commission as occupying a public place along all streets,
boulevards, malls, parks, or other public highways or rights-of-way,
excluding alleys, in the Borough.
REPLACEMENT TREE
A tree planted at a site or location formerly occupied by
a public shade tree. A public shade tree must have formerly occupied
the site within the last two years in order for a tree to be considered
a replacement.
RIGHT-OF-WAY
The strip of land over which is built a public road, the
width of which may extend beyond the area actually used as a road,
where any part is open to the use of the public for purposes of vehicular
and pedestrian traffic.
TOPPING OF TREES
Tree topping is the drastic removal, or cutting back, of
large branches in mature trees, leaving large stubs with open wounds
which subject the tree to disease and decay, ultimately resulting
in early failure or death of the tree.
