The following words, when used in this chapter, shall have the meaning ascribed to them in this section unless stated otherwise:
ANIMAL
The male and female gender, including neutered, spayed or gelded animals, including but not limited to, cats, dogs, horses or any other common household domesticated or companion animals.
AT LARGE
When used in reference to dog, cat, horse or other common household domesticated or companion animals, shall mean off the premises of the owner unaccompanied by the owner, and not under the control of the owner.
CONTROL
Tethering, leashing or other physical means of restraint, and shall not include nonphysical restraint such as by verbal or nonverbal commands.
OWNER
When applied to the proprietorship of a dog, cat, horse or any other common household domesticated animals, shall include every person having a right or property in such an animal and every person who keeps or harbors such an animal, or has it in his care, and every person who permits such an animal to remain on or about any premises occupied by him.
PERSONS
Include individuals, corporations, copartnerships and associations. The singular shall include the plural and the masculine shall include the feminine.
It shall be unlawful for the owner or keeper of any such animal to allow that animal to run at large off their premises.
A. 
No animal and/or person having possession, custody or control of such an animal shall allow that animal to defecate upon any gutter, street, driveway, alley, curb or sidewalk in the Borough or upon floors or stairways of any building or place frequented by the public or used in common by the tenants, or upon the outside walls, walkways, driveways, alley, curbs or stairways of any building abutting on the public street or park or upon the grounds abutting on the public street or park or upon the grounds of any public park, public areas or upon private property other than the property of the owner.
B. 
Any such animal owner or a person having possession, custody or control of such animal which defecates in any area other than the private property of the owner of that animal, as prohibited in Subsection A hereof, shall be required to immediately remove the feces from such surfaces and carry the same away for proper disposal in a sanitary sewer receptacle.
C. 
Exception. The provisions of this section shall not apply to a guide dog accompanying any blind person or to a dog used to assist any other physically handicapped person or to animals used in any police or fire activities of the Borough.
D. 
No animal owner shall allow animal defecation to accumulate on his property to the point where it becomes a health hazard and/or a public nuisance.
