A.
It is the intent, purpose and scope of this chapter to protect and
promote safety, health, and morals; to provide for the general welfare
by guiding and protecting amenity, convenience, future governmental,
economic, practical, and social and cultural facilities, development
and growth, as well as the improvement of governmental processes and
functions; to guide uses of land and structures, type and locations
of streets, public grounds and other facilities.
B.
All recommendations made by the Planning Commission to Council of
the Borough of Clifton Heights shall be advisory only.

A.
The Planning Commission shall consist of seven members, all of whom
shall be residents of the Borough of Clifton Heights and citizens
of the United States of America.

B.
No Planning Commission member may be a full-time employee of the
Borough of Clifton Heights.
All members of the Planning Commission shall be appointed by
the Council of the Borough of Clifton Heights. The term of each member
shall be for four years, or until his successor is appointed and qualified,
except that, for the terms of the members first appointed, no more
than two shall be reappointed or replaced during any future calendar
year. All members shall serve without compensation but may be reimbursed
for necessary and reasonable expenses.
All vacancies shall be filled for the unexpired term by the
Council of the Borough of Clifton Heights. The Chairman of the Planning
Commission, upon the happening of any vacancy, shall promptly notify
Borough Council of such fact.
Any member of the Planning Commission once qualified and appointed
may be removed from office for malfeasance, misfeasance or nonfeasance
in office or for other just cause by a majority vote of Borough Council,
taken after the Commission member has received 15 days' advance notice
of the intent to take such a vote. A hearing shall be held in connection
with the vote if the member shall request such a hearing in writing.
Any appointment to fill a vacancy created by removal shall be only
for the unexpired term.
A.
The Commission shall elect its own Chairman and Vice Chairman and
create and fill such other offices as it may determine.
B.
Officers shall serve annual terms and may succeed themselves.
C.
The Commission may make and alter bylaws and rules and regulations
to govern its procedures consistent with this chapter and the laws
of the Commonwealth of Pennsylvania.
D.
The Commission shall keep a full record of its business and shall
annually make a written report by March 1 of each year of its activities
to Borough Council. Interim reports may be made as often as may be
necessary or as requested by Borough Council.
A.
For the administration of the Planning Department, the Planning Commission
may appoint a Director of Planning who shall be qualified for the
duties of his position. Such appointment shall be approved by and
his salary determined by Borough Council.
B.
The Director of Planning shall be in charge of the administration
of the Department and shall exercise the powers and be subject to
the duties that are granted or imposed upon the Planning Commission
by this chapter.
The Planning Commission, with the consent of Borough Council,
may accept and utilize any funds, personnel or other assistance made
available by the County of Delaware, the Commonwealth of Pennsylvania
or the federal government or any of their agencies, or from private
sources. Borough Council may enter into agreements or contracts regarding
the acceptance or utilization of the funds or assistance in accord
with the procedures approved by Council.
A.
The Planning Commission shall have the power and shall be required
to:
(1)
Prepare the Comprehensive Plan for the development or redevelopment
of the Borough of Clifton Heights and present it for the consideration
of Borough Council;
(2)
Maintain and keep on file records of its action. All records and
files of the Planning Commission shall be retained at Borough Hall
and be available to Borough Council;
(3)
Prepare and present for consideration to Borough Council and, after
adoption, maintain an Official Map and make recommendations to Council
on proposed changes in such map;
(4)
Prepare and present to Borough Council a zoning ordinance and make
recommendations to Council on proposed amendments to such ordinance;
(5)
Prepare and administer subdivision and land development regulations;
(6)
Prepare and administer planned residential development regulations;
(7)
Prepare and present to Borough Council a building code and make recommendations
to Council on proposed amendments;
(8)
Prepare and present to Borough Council a housing code and make recommendations
to the governing body on proposed amendments thereto;
(9)
Submit to Borough Council a recommended capital improvements program;
(10)
Promote public interest in, and understanding of, the Comprehensive
Plan and planning;
(11)
Make recommendations to governmental, civic and private agencies
and individuals as to the effectiveness of the proposals of such agencies
and individuals;
(12)
Hold public hearings and meetings;
(13)
Require from other Borough officers and employees such available
information as relates to the work of the Planning Commission;
(14)
In the performance of its functions, enter upon any land to make
examinations and surveys either after permission has been obtained
from the owner or after public notice; and
(15)
Do such other act or make such studies as may be necessary to fulfill
the duties and obligations imposed by this chapter.
B.
In the performance of its powers and duties, any act or recommendation
of the Planning Commission which involves engineering consideration
shall be subject to the approval of the Borough Engineer.
