This article shall be known as the "North Versailles Sewer Connection Ordinance", and is designated as Chapter 238, Article V, in the Code of North Versailles Township. The whereas clauses are incorporated into and made a part of this article.[1]

A. 
It is declared to be the intent of North Versailles Township to eliminate the discharge of surface water into the sanitary sewer system, and to prohibit and require the removal of private connections that allow extraneous surface water to enter the publicly owned sanitary sewers that are directly or indirectly tributary to a public sanitary sewer system.
B. 
No structure or building shall permit any surface water to be channeled into the sanitary sewer system. It is the intent of this article that the substantial reconstruction, demolition, razing, or removal of any structure shall be the loss of any preexisting right, if any, to utilize or construct a combination sewer; any reconstruction, rebuilding or repair of any structure must be in full compliance with this article and no surface water shall be permitted to be discharged into the sanitary sewer system.
C. 
No person or entity shall permit any extraneous surface water to enter into a publicly owned sanitary sewer system either directly or indirectly.
D. 
Where used herein, reference to a "plumber" shall mean a person registered as a plumber with the Allegheny County Health Department.
E. 
Where used herein, the office of Code Enforcement Officer shall include the office of North Versailles Township Sanitary Authority Foreman.
Whenever the Code Enforcement Officer ascertains or determines that a service or lateral sanitary sewer line is defective in any manner, or has reason to suspect the same, he is hereby authorized and directed to provide a written notice to the property owner of such condition and demand that the same be cured. The property owner shall repair, replace, remedy or otherwise rehabilitate all such defects within 30 days of the date of the written notice, or within such longer period of time as the Code Enforcement Officer shall reasonably allow.
A. 
From the effective date of this article, every owner of land in the Township of North Versailles upon which a structure is erected the sewer lines from which drain into the ALCOSAN basin shall, by May 31, 2007, obtain a certification of dye testing from the North Versailles Township Sanitary Authority. Property owners shall make application for evidence of compliance on a form furnished by the North Versailles Township Sanitary Authority. The application form shall be issued upon payment of a fee of $20.
B. 
Dye testing may be performed only by either a registered plumber in the presence of the North Versailles Township Sanitary Authority Foreman or other North Versailles Township Sanitary Authority authorized representative or by the North Versailles Township Sanitary Authority no less than 60 days prior to the date submitted to the Authority. If the dye test reveals that surface water is being discharged into the sanitary sewer system, no certificate of compliance will be issued until after necessary repairs have been made and a retest is completed, showing compliance with this article. Only the North Versailles Township Authority Foreman shall have authority to issue a certificate of compliance to the owner of the real estate after the terms and conditions of this article have been met.

From the effective date of this article, any owner, transferee, transferor or subsequent owner of land upon which a structure is erected in the Township of North Versailles, prior to any transfer of ownership, must make application to the North Versailles Township Sanitary Authority for a pre-sale dye test. Upon payment of a fee of $20, an application shall be given to the applicant. Dye testing may only be performed by a plumber in the presence of a North Versailles Township Sanitary Authority Foreman or his designated representative no more than 120 days prior to the date of sale or transfer. Upon successful completion of the dye test, the North Versailles Township Sanitary Authority foreman or his representative shall issue a certificate of compliance to the transferor or transferee of the real estate. If repairs are needed, a retest must be performed following the repairs in the presence of the North Versailles Township Sanitary Authority Foreman or his representative. Upon compliance with this article, a certificate of compliance will be issued.
Any party aggrieved by the decision of the Code Enforcement Officer or Foreman, who or which has an interest in the matter, including the Township of North Versailles or the Township of North Versailles Authority, may file an appeal to the North Versailles Zoning Hearing Board within 20 days of the decision of the Code Enforcement Officer or Foreman, which is given jurisdiction to hear and determine such questions.
Every structure in the Township of North Versailles must have an occupancy permit prior to a change of occupancy, which must be accompanied with a certificate demonstrating compliance with the obligations described in this article. No buyer or transferee may buy, take title or occupy land without first complying with the provisions of this article. No owner or seller of land may convey title to land without first complying with the provisions of this article.
The duties and obligations created herein by North Versailles Township are limited to those within the jurisdiction of the Township. Those matters under the control of the North Versailles Township Sanitary Authority shall remain under its exclusive jurisdiction and control. Those matters are set forth here solely for the purpose of approval of the action by the Authority.
The fees and charges imposed herein may be amended by simple resolution.
Every violation of this article shall be deemed to be a separate civil offense and punishable by a fine up to $1,000 and costs.
