As used in this chapter, the following terms shall have the
meanings indicated, unless a different meaning clearly appears from
the context:
Borough of Dravosburg.
The actual owner, agent, or custodian of the property on
which portable sheds are stored; whether individual or partnership,
association, or corporation.
Any natural person, firm, partnership, association, corporation
or other legal entity.
Portable sheds (hereinafter referred to as "POD") that are
located with materials and placed on a residential property for the
purpose of storing materials.
Before placing a POD unit on his/her property, a person must
submit an application and receive a permit from the Borough Code Enforcement
Officer. An insurance certificate providing liability insurance in
the amount of $100,000 provided by the company supplying the POD must
accompany the application. There is a fee of $25 for a thirty-day
permit.
A.
Permits will be granted for a period of 30 days. At the expiration
of the thirty-day period, applicants may seek to extend their permits
for an additional 30 days by seeking an extension for cause from the
Borough Code Enforcement Officer.
B.
Extension of a permit will cost $25 for each 30 days granted.
Only one POD unit may be placed at any residential property
at one time.
Any person who shall violate any provision of this chapter shall,
upon conviction thereof, be sentenced to pay a fine of not more than
$600 and/or to undergo imprisonment for a term not to exceed 90 days.
Each day that a violation of this chapter continues shall constitute
a separate offense.
The remedies provided herein for the enforcement of this chapter,
or any remedy provided by law, shall not be deemed mutually exclusive;
rather, they may be employed simultaneously or consecutively, at the
option of the Borough Council.
