Underground mining, as it is commonly defined, namely, the mining, removal or recovery of coal by way of shaft or tunnel entry, or mining for the digging and removal of coal from coal beds or coal seams in their natural or previously mined condition, is hereby prohibited within the Township of North Versailles because, in the judgment of the Board of Commissioners of the Township of North Versailles, such mining operation or operations endanger or may endanger the health, safety, property values, tax bases, progress, planning, development, and general welfare of the Township of North Versailles, both as to its residents and their properties, as well as property of nonresident owners, or users of any property, including public properties of the Township of North Versailles, East Allegheny School District, and the various water, school, and sanitary sewer authorities, and other public bodies and utilities.
Any person, partnership, association, or corporation, whether owner, lessee, or other, who engages in underground mining of coal or who is or becomes the owner of coal recovered as a result of such mining within the Township of North Versailles in violation of the provisions of this article shall, upon conviction before any Magisterial District Judge having jurisdiction in the matter, forfeit and pay to the Township of North Versailles the sum of $1,000 for each day the violation is committed, and the further sum of $1,000 for each additional day the violation is permitted to continue.
