The provisions of this chapter shall be enforced by the enforcement
officer of the Town, whose duties shall be to enforce all provisions
of this chapter as prescribed herein or such provisions as may hereafter
be enacted. The enforcement officer of the Town of Martinsburg or
other law enforcement officials or agents of the Town of Martinsburg
shall have the right to enter upon the premises upon which any mobile
home is located or about to be located and inspect the same and all
accommodations connected with at any reasonable time. Individual members
of the Town Board and their duly authorized representatives shall
have like power of inspection.
Any person, firm or corporation who shall have been denied a
mobile home permit, mobile home park permit or trailer park permit
may within 10 days thereafter request a hearing by the Town Board
by giving written notice to the Town Clerk. Within 30 days after receipt
of such notice by the Town Clerk, the Town Board shall conduct a hearing
at which such person, firm, or corporation shall be present to be
heard and at which witnesses' testimony may be taken. Thereafter,
and within 30 days of such hearing or any adjourned date thereof,
the Town Board of the Town of Martinsburg shall issue a decision in
writing, affirming, amending or reversing such previous action and
specifying therein the reason for such action and the facts upon which
it is based.
Any person, individually or acting for a firm or a corporation,
who violates any provisions of this chapter shall be guilty of a misdemeanor
and subject to a fine of not more than $1,000 or to imprisonment for
a period of not more than six months or both. In addition, any and
all persons who violate any of the provisions of this chapter or who
shall omit, neglect or willfully refuse to do any act required by
this chapter shall severally, for each and every such violation or
noncompliance forfeit and pay a civil penalty of $1,000. The imposition
of all penalties for any violation of this chapter shall not excuse
the violation or permit it to continue. The application of the above
penalty or penalties or the prosecution of the violation of the provisions
of this chapter shall not be held to prevent the enforced removal
of such conditions prohibited by this chapter or the taking of such
other action as may be authorized by this chapter.
