No person shall drink or open any container with the intent
of consuming any alcoholic beverages as defined in MGL c. 138, § 1,
while in, on or upon any public way or any way to which the public
has access; and no person shall drink or open any container with the
intent of consuming any alcoholic beverages as aforesaid, in, on or
upon any private land or place, without the consent of the owner or
person in control of such public or private land or place when so
posted by such private owner.
A.
Anyone violating
this section may be arrested by a police officer without a warrant.
All alcoholic beverages being used in violation of this section may
be seized and held until final adjudication of the charge against
any such person has been made by the court.
