The City Council finds that to protect the public safety and welfare as an exercise of its police power, it is necessary to know whether prospective employees of the Board of Water Supply have a history of criminal activity which may make them unsuitable as Board of Water Supply employees due to the nature of such employment or activity.

A. 
Any applicant for employment by the Board of Water Supply shall sign a release authorizing the City to submit such applicant's fingerprinting to the New York State Division of Criminal Justice Services (DCJS) and to receive the results or reports of such criminal history record search.
B. 
Further, any applicant shall submit his/her fingerprints on cards provided for that purpose used by the DCJS. Said fingerprintings shall be taken by a member or authorized representative of the City of Mount Vernon Police Department at the time of application and submitted to said DCJS for processing for criminal record history check:
(1) 
All prospective employees of the Board of Supply. The requirements of this section shall apply to prospective employees who apply on or after March 30, 2008.

If a prospective employee has been convicted of a felony and/or a misdemeanor, any decision regarding such prospective employee's fitness for a position must be made upon a review of the factors contained in New York State Correction Law §§ 751 through 753.
The Chief of the City of Mount Vernon Police Department, or designee, shall be responsible for obtaining the fingerprints of said applicants on the appropriate DCJS cards and forwarding same to said Division with the appropriate fees for identification processing. Said Chief shall be responsible for reviewing the criminal history record information provided by DCJS and ensuring the confidential use of such information only for the purpose of employment, as applicable.
The applicant shall pay for any fees associated with the criminal history record search and fingerprinting.
