It shall be unlawful for any person to dump, transfer or deposit garbage, rubbish or other refuse of any kind in the Town of Barton except as provided in this article. The refuse transfer station established at the corner of Sleepy Hollow Drive and Lighthouse Lane shall be the only authorized garbage and refuse disposal facility in the Town.
The use of the refuse transfer station is limited to residents of the Town, and its use by all others is prohibited.
No dumping or admission to the refuse transfer station site shall be permitted except on Saturdays between the hours of 12:00 noon and 4:00 p.m., November through April, and between the hours of 8:00 a.m. and 12:00 noon, May through October. Such hours of operation shall be posted at the site.

A. 
Any Town resident may dispose of any acceptable material at the refuse transfer station site in a manner as directed by the Town attendant on duty at the site.
B. 
Acceptable material which may be disposed of at the refuse transfer station site is limited to the following:
(1) 
Household garbage, rubbish and refuse, provided it is contained in plastic bags or other disposable containers.
(2) 
Newspapers and other waste papers, provided they are contained in plastic bags or other disposable containers or tied in bundles.
(3) 
Such other materials as the Town attendant on duty at the site shall determine, in his sole discretion, to be acceptable.
C. 
It shall be unlawful for any person to dispose of any unacceptable materials at the refuse transfer station site, including but not limited to the following:
(1) 
Materials which do not comply with Subsection B above.
(2) 
Building materials, including debris resulting from construction or demolition.
(3) 
Dead animals.
(4) 
Motor vehicles or parts thereof, machinery or parts thereof, and related equipment.
(5) 
Stones.
(6) 
Tree limbs, shrubbery, brush, wood materials, grass or leaves.
(7) 
Hot ashes.
(8) 
Toxic and hazardous wastes such as explosives, acids, pathological wastes, radioactive materials, flammable materials and other chemical or liquid wastes which require special handling and disposal to protect the environment.
(9) 
Such other materials as the Town attendant on duty at the site shall determine, in his sole discretion, to be unacceptable.
The Town Board shall designate someone to act as an attendant at the refuse transfer station site during its hours of operation. The attendant shall be responsible for carrying out this article.
Any person who shall be found guilty of violating any of the provisions of this article shall be required to pay a forfeiture of not less than $50 nor more than $200, together with the costs of prosecution, and, in default of the payment of such forfeiture, shall be imprisoned at the county jail of Washington County until such forfeiture and all costs, including subsequent costs, have been paid, but not for a period exceeding 30 days.
